Local Law #1 of 2008
ESTABLISHMENT OF RESIDENTIAL AND NON-RESIDENTIAL WATER RATE CLASSES
PURPOSE:
In order to differentiate between two distinct types of water consumers in the Village of Candor Water Department, separate rate classes for residential and non-residential customers shall be established and adhered to for all billing purposes.
SECTION 1: ESTABLISHMENT OF RESIDENTIAL RATE CLASS
- (1) The residential rate class shall apply to those water customers that live in and/or own property in which the water meter is located, including property located outside the corporate limits.
- (2) The Candor Village Board may resolve to amend and/or redifine the residential rate class from time to time.
SECTION 2: ESTABLISHMENT OF NON-RESIDENTIAL RATE CLASS
- (1) The non-residential rate class shall apply to those water customers and/or property owners whose property has been established as a business or non-residential end use within or outside the Village of Candor corporate limits as determined by the Candor Village Board.
- (2) The non-residential rate class shall apply to those water customers and/or property owners in which a property is used for commercial purposes, such as collection of multiple rents, sale of merchandise or services, any non-residential public building with water consumption, non-profit organizations, or any other water customer as determined by the Village Board of Trustees.
- (2.1) Water customers considered as commercial purposes or non-residential end use accounts include, but are not limited to:
- (a) Gas Stations
- (b) Apartment Houses (non-owner occupied)
- (c) Mobile Home Parks
- (d) Churches
- (e) Apartment Complexes
- (f) Medical Facilities
- (g) Law Offices
- (h) Schools
- (i) Restaurants
- (j) Banks
- (k) Funeral Homes
- (l) Laundromats
- (m) Bed and Breakfast Facilities
- (n) Insurance Companies
- (o) Assisted Living Homes or Facilities
- (p) Non-Profit Organizations
- (q) Repair Facilities
- (r) Brs and Lounges
- (s) Stores of Any Type
- (t) New and/or Used Car Sales
- (u) Nursing Homes
- (v) Post Offices
- (w) Food Establishments
- (x) Beauty Shops
- (y) Dental Offices
- (z) Any other establishment as determined by the Candor Village Board
- (3) The Candor Village Board may resolve to amend and/or redefine the definition of the non-residential rate class from time to time.
SECTION 3: SEVERABILITY
If any section, paragraph, sentence, clause, phrase, or provision of this Local Law be held invalid or declared unconstitutional in any court for any reason, the remainder of said Local Law shall not be affected thereby.
SECTION 4: EFFECTIVE DATE
This Local Law shall take effect on June 1, 2008, and upon filing in the office of the New York State Secretary of State in accordance with Section 27 of the Municipal Home Rule Law.
