Local Law #1 of 2006

PENALTIES FOR VIOLATIONS COMMITTED AGAINST PROVISIONS OF THE VILLAGE OF CANDOR WATER DEPARTMENT REGULATIONS

PURPOSE:

The purpose of this Local Law is to protect the health, safety, and welfare of the citizens of the Village of Candor by penalizing any individual or individuals who knowingly, purposely, or otherwise do(es) commit certain violations in relation to the provisions set forth in The Village of Candor Water Department Regulations Handbook.

SECTION 1: PENALTIES

1. 1.1 TAny person committing a violation against any provision of the Village of Candor Water Department Handbook shall, upon conviction thereof, be guilty of a violation persuant to the Penal Law of the State of New York, punishable by a fine not exceeding two hundred fifty dollars ($250.00), or by imprisonment for a term not exceeding fifteen (15) days, or by both such fine and imprisonment.



2. 1.2 Each week a violation is continued shall be deemed a separate offense.



3. 1.3 If a person fails to abate any violation of this Local Law within thirty (30) calendar days after written notice has been served personally upon said person, or within forty (40) calendar days after written notice has been sent to said person by certified mail at said person's home or business address, said person shall be subject to a civil penalty of not less than fifty dollars ($50.00) for each and every week that the violation continues, recoverable by suit brought by the Village and to be retained by the Village.



4. 1.4 Any violation of this Local Law may be enjoined persuant to law.



5. 1.5 The penalties provided for herein shall be cumulative, and shall be in addition to any penalties provided by law.

SECTION 2: PARTIAL INVALIDITY

If any section of this Local Law shall be held unconstitutional, invalid, or ineffective in whole or in part, such determination shall not be deemed to affect, impair, or invalidate the remainder thereof.

SECTION 3: EFFECTIVE DATE

This Local Law shall take effect immediately upon being filed in the office of the Secretary of the State of New York.

I hereby certify that the local law annexed hereto, designated as Local Law No. 1 of 2006 of the Village of Candor, New York, was duly passed by the Board of Trustees on January 17, 2006, and was approved by the Mayor and was deemed duly adopted on January 17, 2006, in accordance with the applicable provisions of law.

I further certify that I have compared the preceding Local Law with the original on file in this office and that the same is a correct transcript therefrom and of the whole of such original Local Law, and was finally adopted in the manner indicated in paragraph 1, above.
