Local Law #1 of 2006

REGULATION OF THE RESIDENCE OF REGISTERED SEX OFFENDERS IN CERTAIN SECTIONS OF THE VILLAGE OF CANDOR

BE IT ENACTED by the Board of Trustees of the Village of Candor, New York, as follows:

SECTION 1: PURPOSE

The Village Board of the Village of Candor finds that the first priority of government is to protect the health and safety of the residents. A significant number of these individuals have been categorized as Level II Sex Offenders who have been determined by the New York State Department of Corrections to be at moderate risk of committing another sexual crime; and a significant number of these individuals have been categorized as Level III Sex Offenders who have been determined by the New York State Department of Corrections to be at high risk to commit another sexual crime and thus pose a threat to public safety. Therefore, it is paramount that action be taken to safeguard the children of the Village of Candor from these Level II and Level III Sex Offenders.

SECTION 2: PROHIBITION

Registered Level II and Level III sex offenders are hereby prohibited from living within a radius of 1,000 feet from any church, school, park, playground, cemetary or day care center located in the Village of Candor.

SECTION 3: ENFORCEMENT

Notification of such prohibition shall be delivered in writing to each and every Registered Sex Offender residing within the Village of Candor, as well as those residing within Tioga County, and to the Village of Candor Police Department, the New York State Division of Parole, the Tioga County Probation Department, and the Tioga County SHeriff's Department.

SECTION 4: PENALTIES FOR OFFENSES

Any person who shall violate any provision of this article shall, upon conviction thereof, be subject to a fine of not more than five hundred dollars ($500.00), or to imprisonment for not more than fifteen (15) days, or to both such fine and imprisonment.

SECTION 5: EFFECTIVE DATE

This Local Law #1 of the Year 2005 shall be effective immediately upon being filed in the Office of the Secretary of the State of New York.

I further certify that I have compared the preceding Local Law with the original on file in this office and that the same is a correct transcript therefrom and of the whole of such original Local Law, and was finally adopted in the manner indicated in paragraph 2, above.
