REGULAR MEETING
VILLAGE OF CANDOR BOARD OF TRUSTEES

After the Pledge of Allegiance, the regular meeting of the Village of Candor Board of Trustees was called to order at 6:30 pm by the Honorable Mayor Steven Sparling at the Village Hall, 138 Main Street, Candor, NY, on February 2, 2010.

Those in attendance included Trustees Chris Brown, Nancy King and Gary Consalvi; Clerk Jan Swartz; Deputy Clerk Jean Dewey; Public Works Marvin Roberts; Attorney Kurt Schrader; The Candor Chronicle reporter Jesse Disbrow; Mike Swartz; and Frank Musgrave.

Charge of the Committee – Frank Musgrave, an appointed member of the Dissolution Study Committee, questioned the wording of the charge given to them at their initial meeting on February 1. He had a concern that it presupposes a positive motion of the committee when it should instead be a consideration of a dissolution; whether it has a positive or negative value as a result; and that alternatives to dissolution should be presented. Discussion ensued. Attorney Schrader will draft another version of the charge for consideration at the next Board meeting on February 16th when official action can then be taken. Frank Musgrave left the meeting at 6:38 pm.

Minutes – Minutes of the January 19th, 2010, meeting were discussed. Trustee Brown requested a change be made to the paragraph regarding cell phone usage, indicating billing is subject to IRS review as it's tax free and that the Village should be aware of what's being billed as business use versus what's being billed for personal use. Trustee Brown then made a motion to accept the minutes of the January 19th meeting as amended. Trustee King seconded the motion and Trustees Brown, King and Consalvi voted aye. The motion was approved and carried.

Dissolution Study Committee – Mayor Sparling gave a brief report of the first dissolution study committee meeting held on February 1, 2010, at the Town Hall. All members were in attendance with the exception of Butch Crowe who had a prior commitment. The committee has chosen to meet the second and fourth Monday of each month at 7 pm at the Town Hall.

Mayor Sparling selected Bob Houck, Jerry Ahart, Frank Musgrave, Fred Quinlan, and Gwen Isham as Village committee members and Teresa Twarz and Butch Crowe as Town committee members. A motion was made by Trustee Consalvi, seconded by Trustee Brown, to approve them as official dissolution study committee members. A vote was taken and Trustees Consalvi, Brown and King voted aye. So moved.

Trustee Position – Mike Swartz has expressed interest in filling the term of office of the Trustee seat recently vacated by Fred Martinez. Mayor Sparling then appointed Mike to fill the position through April 2010. Mike will need to be re-appointed again at the organizational meeting in April to fulfill the remainder of the term through March 2011.

REAP Vacancy – Florence Alpert was asked to consider filling the REAP position vacated by Fred Martinez when he resigned in January. However, she was absent from the meeting and the Mayor hadn't had discussion with her. Discussion followed. The REAP program will probably be discontinued due to State budgetary cuts, so the Board felt there was no immediate, if any, need to fill the vacancy. Tabled.

Cell Phone Usage – Personal and business calls need to be denoted on the bill per NYCOM's suggestion. Marvin will comply by identifying same on the bills.

Lower Bridge – Trustee Consalvi reported that the lower bridge has a rating of 3.4, but it must be rated at 3 or under before the State will consider replacing it. Discussion followed. Due to the heavy amount of truck traffic that is going through the Village and traveling over the bridge , rather than following the truck route, the Board continues to have concern. The weight limit signs are small and not located where they're easily visible for truckers. It was suggested the State install larger signs and move them closer to the intersections.

Darlington Lawsuit – Attorney Schrader briefly discussed the lawsuit that Darlingtons have brought against the Town and naming the Village as a defendant. He suggested the Village may want to re-enter the lawsuit.

Polling Place – A motion was made by Trustee Brown, seconded by Trustee King to have the annual Village polling place at the Candor Free Library on March 16th from noon until 9 pm. A vote was taken and Trustees Brown, King, Consalvi and Swartz voted aye. So moved.

Election Inspectors – A motion was made by Trustee Brown, seconded by Trustee King to have Rita Quinlan appointed as Senior Election Inspector and Sylvia Johnson as Election Inspector for the March 16th Village elections. A vote was taken and Trustees Brown, King, Consalvi and Swartz voted aye. The motion was approved and carried.

Consultants for Dissolution Study Committee – Many villages have used consultants from the CGR firm in Rochester. Attorney Schrader suggested the Village should check with other options.

Communications – Time Warner Cable sent notification that agreements with several of their programmers were to expire soon and there was a possibility they would cease carriage of one or more of those services. If that happens, they had a listing of other options they may add to their line-up.

NYS Department of Environmental Conservation sent a letter indicating that it's requiring those water systems withdrawing more than 100,000 gallons of groundwater or surface water per day to file a report with the Department and include a $50 fee. The Village doesn't withdraw that amount of water, so we are exempt from that requirement.

There being no further business, the meeting adjourned at 7:15 pm.
