REGULAR MEETING
VILLAGE OF CANDOR BOARD OF TRUSTEES

After the Pledge of Allegiance, the regular meeting of the Village of Candor Board of Trustees was called to order by the Honorable Mayor Steven Sparling on January 19th, 2010, at 6:30 pm at the Village Hall, 138 Main Street, Candor, NY.
Those in attendance included Trustees Nancy King, Chris Brown and Gary Consalvi; Clerk Jan Swartz; Deputy Clerk Jean Dewey; Attorney Kurt Schrader; and Florence Alpert.
Florence Alpert – Mrs. Alpert was given the floor and questioned whether the Board was going to pursue a grant and a consultant for the upcoming Village dissolution committee. She was advised that the Board was going to let the committee members decide on the amount of grant money they would need as well as the needs regarding a consultant. The Mayor announced that the first meeting for the dissolution committee will be on February 1, 2010, at 7 pm at the Candor Town Hall.
Minutes – A motion was made by Trustee Consalvi, seconded by Trustee King, to approve the January 5th, 2010, minutes as presented. A vote was taken and Trustees Consalvi, King and Brown voted aye. The motion was approved and carried.
Dissolution Study Committee – The last appointment made by Mayor Sparling to the dissolution study committee was town resident Butch Crowe. The membership now consists of Teresa Twarz and Butch Crowe from the town; Frank Musgrave, Jerry Ahart, Gwen Isham, Fred Quinlan, and Bob Houck from the village.
Bridge Audit Report – Trustee Consalvi has still not received the latest audit of state bridges, and he expects it to be available the first week of February.
Acceptance of Resignation – A motion was made by Trustee Consalvi, seconded by Trustee Brown, to accept the signed resignation of Fred Martinez, dated January 5, 2010. A vote was taken and Trustees Consalvi, Brown and King voted to approve. So moved.
REAP Representative – With the resignation of Fred Martinez, a Village seat on the REAP Committee has been vacated. Discussion was held and Florence Alpert was asked if she would consider taking the position. She agreed to contemplate the request.
Cell Phone Usage – NYCOM members (of which the Village is one) were notified that they should become more aware of cell phone usage regarding what's business and what's personal as it's subject to IRS review. Discussion followed.
Christmas Ornaments – The annual sale for pole-mounted Christmas ornaments is now in effect until the end of February (buy two, get one free). Members of the Board reviewed the brochure and Trustee King made a motion to purchase additional shooting star ornaments for $525 each as well as another bag of replacement LED bulbs. The motion was seconded by Trustee Brown. A vote was taken and Trustees King, Brown and Consalvi voted aye. The motion was approved and carried.
Open Trustee Position – Discussion was held regarding the need to fill the vacant Trustee's position. Mike Swartz has expressed interest in the position and Trustee King will further verify that with him.
Reports – The police, financial and justice reports were reviewed. The justice report showed a total of $1,055 was collected in fines and forfeitures for December 2009 and check #648 was issued to the Village of Candor by the Justice Court on January 10th, 2010, in that same amount. A motion was made by Trustee Brown, seconded by Trustee King, to accept the justice report as submitted. A vote was taken and Trustees Brown, King and Consalvi voted aye. The motion was approved and carried.
Transfer – A motion was made by Trustee Consalvi, seconded by Trustee Brown, to transfer $166 from the water fund contingency F1990.4 to the water fund central data processing F1680.4 to cover the shortfall in that account for the software support contract. A vote was taken and Trustees Consalvi, Brown and King voted aye. Motion approved.

A motion was made by Trustee Consalvi, seconded by Trustee King, to approve the bills as presented. A vote was taken and Trustees Consalvi, King and Brown voted aye. So moved.
Snowmobilers and Dogs – Trustee King expressed concern about snowmobilers driving on the sidewalk and dogs disturbing neighbors by barking.
Darlington Litigation – Attorney Schrader reviewed a lawsuit brought against the Town by Mr. and Mrs. Darlington, in which the Village has been named a defendant, but didn't respond within the time limitation noted. He expected the Village would be able to change that ruling, if the Board chose to, and that was the general consensus. Attorney
Schrader also indicated the David Weber was to have surrendered the Village's files to the Town Supervisor on the Village's behalf.
There being no further business, the meeting adjourned at 7:18 pm.
