REGULAR MEETING
VILLAGE OF CANDOR BOARD OF TRUSTEES

DECEMBER 15, 2009

After the Pledge of Allegiance, the regular meeting of the Village of Candor Board of Trustees was called to order at 6:30 pm on December 15, 2009, by the Honorable Mayor Steven Sparling at the Village Hall, 138 Main Street, Candor, NY.

Those in attendance included Trustees Gary Consalvi, Chris Brown, and Nancy King; Clerk Jan Swartz; Deputy Clerk Jean Dewey; DPW Marvin Roberts; Attorney Kurt Schrader; Ron Fay; Florence Alpert; and Jesse Disbrow, reporter for The Candor Chronicle. Trustee Fred Martinez was absent.

Condition of Jackson Street – Ron Fay expressed concern of the condition of Jackson Street, indicating “it’s a mess.” There are three driveways on the street and only one access, so he believes that to be a contributing factor to the street getting torn up.

Search Warrants – Ron Fay gave a history on the evolution of search warrants and expressed dissatisfaction with the fact one was served on a family member within the past several weeks. He left the meeting at 6:36 pm.

Minutes – A motion was made by Trustee Consalvi, seconded by Trustee Brown, to approve the minutes of the December 1, 2009, meeting as presented.

Dissolution Study Committee – Mayor Sparling announced he has had four Village residents (Gwen Isham, Jerry Ahart, Fred Quinlan, and Bob Houck), as well as one Town resident (Teresa Twarz) to agree to be on the dissolution study committee.

Hamill Easement – Attorney Schrader brought the final draft of the easement for the Hamill property on Water Street for signing.

In relation to the Hamill property, discussion was held regarding the recent concerns the Board has had with the traffic congestion in that area on Wednesday afternoons during the Bread of Life food distribution. It was decided the property owner should put up signs noting it’s a private drive if the owner deems it to be necessary. In addition, Trustee King agreed to talk to Sherry Haner to let her know of the parking problems that are being created on Wednesdays in that area.

Rural Water Meeting – Mayor Sparling reminded the Board that Steve Winkley from Rural Water will be holding a meeting at the Town Hall on December 17 at 7 pm. The Mayor has asked Greg Cummings from Larson Design to be in attendance, as well.

Lower Bridge Update – Trustee Consalvi contacted the State Department of Transportation and requested an inspection report for the lower bridge in Candor. The report, issued in 2008, shows startling photographs of the underside of the bridge and underlines the Village’s concerns for the safety of the bridge. The 2009 inspection report won’t be available until the spring of 2010. Discussion was held regarding having the Town, the school, and the Village join together in submitting their concerns to the State DOT as the bridge has a 25,000 pound limit on it, and it’s obviously not being adhered to.

Traffic Light Request – The Mayor tried to contact the engineer from NYSDOT responsible for the intersection study to get an update, but she was out of work due to illness.

December 15, 2009 Minutes

Trucks on Church Street – Discussion was held regarding truck traffic on Church Street. The Mayor had spoken to Kevin Noble earlier this year to ask if his drivers could avoid using Church Street, and they did for awhile. However, making the right turn from Delray onto Main Street is difficult because of the angle of the road and the attached plows make it a safety issue. The Board agreed the trucks would probably have to continue to use Church Street.

Candor Website – The Town’s website, Candorny.us, has the Village’s minutes on it, but not the laws. Trustee King will contact Darlene Cobler and ask her about it.

Sale of Gator’s Pub Bricks – Trustee King brought $13 from the sale of some of the bricks salvaged from Gator’s Pub.

Snow Removal Back-up – The Mayor announced that Nick Thomas can be used as a back-up for Marvin for snow removal as he’s now a Village employee and is willing to do so.

Reports – The financial, police, and public works reports were reviewed. Extensive discussion was held regarding whether to purchase a 6’ x 8’ trench box for public works for $4,500.00. No decision was made.

Transfer – Jean Dewey read the following transfer, made for the snow plow repairs:

A motion was made by Trustee Consalvi, seconded by Trustee King, to approve the transfer as presented. A vote was taken and Trustees Consalvi, King, and Brown voted aye. The motion was approved and carried.

A motion was made by Trustee Brown, seconded by Trustee Consalvi, to pay the bills as Presented. A vote was taken and Trustees Brown, Consalvi and King vote aye. So moved.

There being no further business, the meeting adjourned at 8:01 pm.
