VILLAGE OF CANDOR BOARD OF TRUSTEES

NOVEMBER 3, 2009
After the Pledge of Allegiance, the regular meeting of the Village of Candor Board of Trustees was called to order by the Honorable Mayor Steve Sparling at 6:30 pm on November 3, 2009, at the Village Hall, 138 Main Street, Candor, NY.
Those in attendance included Trustees Chris Brown, Nancy King, Fred Martinez, and Gary Consalvi; Clerk Jan Swartz; Deputy Clerk Jean Dewey; Attorney Kurt Schrader; Ron Fay; Florence Alpert; Bob Hamill; and Steve Winkley, a hydrogeologist from the
New York Rural Water Association.
Concerns with Village – Ron Fay presented a listing of concerns he had with the Village, including suggesting that the Village should assist property owners in locating contractors and electrical inspectors; creating a sign ordinance; and having the Village detail what the County's role is in septic systems. Ron left the meeting at 6:39 pm.
NY Rural Water Association – Steve Winkley, a hydrogeologist with the NY Rural Water Association, presented information for a Source Water Protection Technical Assistance Program, a free state and federally funded program. Upon agreement with the Board of Trustees, he will return to Candor in the future to look at the wells and acquifer, do
field mapping to delineate the drinking water resources, inventory potential sources of contamination, and draft a law to initiate protection strategies for the Village. Discussion followed. Steve left the meeting at 7:15 pm.
Minutes - A motion was made by Trustee Consalvi, seconded by Trustee King, to approve the minutes of the October 20th meeting as presented. A vote was taken and Trustees Consalvi, King, Martinez, and Brown voted aye. The motion was approved and carried.
Request for Easement, 4 Water Street - Bob Hamill asked for an approximate 10' easement from 4 Water Street to the back southwest corner stake of that property where it meets the Ahart and Winnick properties. Discussion followed and a map was reviewed. A motion was made by Trustee Martinez, seconded by Trustee King, to authorize the 10' easement to allow access to the garage and dry well on the property located at 4 Water Street, with the understanding that if the encroachments are ever removed, they can't be rebuilt. A vote was taken and Trustees Martinez, King, Consalvi,
and Brown voted aye. The motion was approved and carried. Bob Hamill left the meeting at 7:28 pm.
Water Service, 37 Stowell Avenue – A letter was sent to George Thomas, the property owner at 37 Stowell Avenue advising him that a separate water service line must be installed to service the mobile home that has been installed behind his home. However, the water service had already been hooked up from the line servicing George's house to the mobile home. Discussion followed. There are separate meters for both residences and separate water bills will be issued.
Easement for 24 Smith Street – The easement for the Amerman/Downs property at 24 Smith Street is complete and is awaiting signatures.
Dissolution Study – Discussion was held regarding forming a dissolution study committee, and Mayor Sparling indicated that both NYCOM and the former chairman of the Johnson City Dissolution Study Committee recommended we hire a consultant. Extensive discussion ensued.
At 7:42 pm, Mayor Sparling moved to go into Executive Session to discuss a possible litigation issue.
Jean Dewey and Florence Alpert left the meeting at 7:43 pm.
At 8:20 pm, Mayor Sparling moved to exit Executive Session.
Possible Committee Members – Mayor Sparling asked the Trustees to consider who they would like to serve on the Dissolution Study Committee so potential names could be presented at the next meeting. In addition, he asked that the Deputy Clerk work on obtaining grant money for the study.
Hydrants – The fire department presented a hydrant test report showing PSI readings and gallons per minute readings for each hydrant. It also showed which hydrants weren't working at all and those that had other problems, such as missing parts. Discussion was held regarding painting the non-functioning hydrants all black. Trustee Martinez will contact Tim Pettis and ask his opinion of how the hydrants should be painted.
Sale of Unclaimed Property – Salvaged bricks from Gator's Pub, as well as the central air conditioning unit and the oak front door will be sold. Trustee King will be in charge of selling the bricks and an ad will be placed in the paper accepting bids for the other items.
Source Water Protection Program – A motion was made by Trustee King, seconded by Trustee Brown, to approve the Village's participation in the New York Rural Water Association's Source Water Protection Technical Assistance Program. A vote was taken and Trustees King, Brown, Consalvi and Martinez vote aye. So moved.
Justice Report – The monthly justice report for September 2009 was reviewed. A motion was made by Trustee Brown to accept the justice report as presented, which showed the justice court collecting fines and forfeitures for the month of September 2009 in the amount of $435.00. The Clerk received check # 644 on October 21, 2009, for that amount from the justice court. The motion was seconded by Trustee King and a vote was taken. Trustees Brown, King, Martinez and Consalvi voted aye. The motion was approved and carried.
Tax Foreclosure Sale – The Clerk read Real Property Transfer Reports that showed 38 Main Street has been sold to Whitney Marchard for $1,500 in a County tax foreclosure sale. In addition, 30 & 32 Main Street have been sold to David and Kenneth Jacobson for $16,000 in the same County tax foreclosure sale.
Accessibility to Coal Barn – Trustee Martinez requested that the Water Street end of the thoroughfare in front of the coal barn be permanently blocked off so that vehicles can't drive through the area and to discourage parking in or around neighboring residences. Extensive discussion ensued. Tabled.

Trustee Brown left the meeting at 8:40 pm.
Notice of Violations & Orders to Comply – The violations, both serious and non-serious, that the Department of Labor described after its inspection of the DPW on September 25, 2009, have been resolved.
Snow Plow Status – The status of the repair of the snow plow was questioned, but because Marvin wasn't at the meeting, it was unknown. Mayor Sparling will check.
Coal Barn Electrical Inspection – As far as the Clerk is aware, the electrical inspection hasn't yet been completed for the rewiring done at the coal barn. Payment is being withheld from Rick Parker until the inspection has been done.
There being no further business, the meeting adjourned at 8:47 pm.
