REGULAR MEETING
VILLAGE OF CANDOR BOARD OF TRUSTEES
138 MAIN STREET, CANDOR, NY
OCTOBER 20, 2009

After the Pledge of Allegiance, the regular meeting of the Village of Candor Board of Trustees was called to order by the Honorable Mayor Steven Sparling at 6:30 pm at the Village Hall, 138 Main Street, Candor, NY, on October 20, 2009.

Those in attendance included Trustees Chris Brown, Nancy King, Fred Martinez, and Gary Consalvi; Clerk Jan Swartz; Deputy Clerk Jean Dewey; Attorney Kurt Schrader; Martha Goodsell, reporter for The Broader View; Jesse Disbrow, reporter for The Candor Chronicle; Leigh Dana, reporter for WBNG-TV; David Slater; Melvin Foster; Florence Alpert; Theodore O’Konsky, Jr.; Donald Quick; and Donald Slater.

Minutes – A motion was made by Trustee Consalvi to accept the minutes of the October 6th meeting as presented. Trustee King asked that the paragraph describing the Halloween Party at the Fire station on October 24th also note that the party is for Candor residents. Trustee Consalvi then motioned to accept the amended minutes and the motion was seconded by Trustee Martinez. A vote was taken and Trustees Consalvi, Martinez, King, and Brown voted aye. The motion was approved and carried.

Easement, 24 Smith Street – Discussion was held regarding granting an easement at 24 Smith Street as a portion of the house is on Village property. A motion was made by Trustee Martinez to grant an easement for the encroachment of the house onto Village property, with the understanding that all responsibility would be borne by the property owner and that any future changes or remodeling to the property will require a permit. The motion was seconded by Trustee Brown. A vote was taken and Trustees Martinez, Brown, King and Consalvi voted aye. The motion was approved and carried.

Snow Plow Repair - Marvin has ordered necessary replacement parts and is waiting for Trux Outfitter of Ithaca to advise him when they have received the parts.

Water Service, 37 Stowell Avenue - Discussion was held regarding the need for the property owner at 37 Stowell Avenue to install a separate water service to the manufactured housing unit that has been placed behind the home at that location.
Trustee Brown will notify Nick Thomas of the requirement.

Petition to Dissolve – A petition to dissolve the Village of Candor was presented to the Clerk on October 14th by Theodore O’Konsky, Jr. and Florence Alpert; the Clerk is currently in the process of reviewing it. Should the petition be deemed invalid, the Mayor suggested to the Board members that the Village move ahead with the formation of a study committee. The Mayor has already contacted the chairman of the Johnson City study committee and will meet with him, the Clerk, and the Village’s attorney soon.
He wanted the community to understand the Village will be pro-active in this endeavor to study the pros and cons of dissolution. The Clerk submitted a report indicating the actions she has taken relative to the submittal of the petition to dissolve the Village.

Kami Harpell entered the meeting at 6:45 pm.

Reports – The financial and police reports were reviewed.

NYCOM Forum – Mayor Sparling, Trustee Consalvi, and Attorney Schrader will attend a NYCOM forum regarding Local Government Consolidation & Dissolution to be held at the East Syracuse-Minoa High School Auditorium on October 22, 2009.

Transfers – The following transfers were presented for approval:

    A5142.4 (Snow Removal)   $2,000.00
        $7,800.00

These transfers would cover expenses incurred for paving and road salt purchase.
A motion was made by Trustee Martinez, seconded by Trustee King, to approve the transfers as presented. A vote was taken and Trustees Martinez, Brown, Consalvi, and King voted aye. So moved.

A motion was made by Trustee Consalvi, seconded by Trustee Brown, to approve the bills as presented. A vote was taken and Trustees Consalvi, Brown, Martinez and King voted aye. The motion was approved and carried.

Public Comment – Theodore D. O’Konsky, Jr. distributed packets that contained copies of Article 19, a copy of the NYS Consolidation & Dissolution Guide, a copy of a NYS High Priority Planning Grant Application, and an excerpt from The Times Journal regarding a study committee to study dissolution. He then read from a prepared statement.

Florence Alpert and Donald Slater thanked the Board for their willingness to move forward with the creation of a study committee.

Melvin Foster left the meeting at 7:00 pm.

There being no further business, the meeting adjourned at 7:01 pm.
