Candor Town Board Meeting September 8, 2009
The Candor Town Board met at the Town Hall, 101 Owego Road. Supervisor Terry Collins called the meeting to order at 7:00pm with pledge to the United States Flag and Clm. Milton Dougherty offered up prayer.
Present: Supervisor Terry Collins, Clm. Joseph Bish, Clm. Darlene Cobler, Clm. Milton Dougherty and Clm. Dan Lindsay.
Others present: Highway Superintendent Kevin Noble, Town Clerk Connie Kulze, 11 people from the public and 1 Press Representative.
Absent: Code Enforcement Officer James Douglas was excused from the meeting.
M-96 Clm. Cobler moved and was seconded by Clm. Lindsay to go into Executive Session regarding Personnel issues at 7:05pm. Vote – 5 ayes and 0 nays.
M-97 Clm. Bish moved and was seconded by Clm. Lindsay to come out of Executive Session at 7:13pm. Vote – 5 ayes and 0 nays.
Privilege of the floor: Valarie Fitzrandolph took the floor stating her dissatisfaction with Code Enforcement Officer Douglas regarding her Demolition Permit and his follow-up after the completion. Also talked about when the Town was going to do a new Assessment and feels they are not fair especially to new comers to the area. Also was appalled at our sign in the waiting area that states God Bless America, our Pledge to the United States and our Prayer. She felt it was inappropriate and that religion should not be a part of our meeting. She also wondered about what the Town of Candor was doing regarding the gas drilling in our area.
Privilege of the floor: Russell Haus took the floor for his elderly mother-in-law Marion Bailey regarding their deed, life use of the house and the taxes. Has been trying to get a hold of Attorney Weber to change the wording so that she can get Enhanced Star on the property where she is living.
Privilege of the floor: Matt Crowe (a Planning Board Member) had questions regarding the Road Preservation Law and stated that the County has removed their involvement. Supervisor Collins asked where he heard this from and Matt Crowe mentioned Chairman Dale Weston of the Tioga County Legislator. If the County is not involved it will go back on the Planning Board of the Town therefore they need some directions for the process.
Privilege of the floor: Kevin Tuttle asked the Board about a motorcycle event called the Hair Scramble which will take place a year from now. He was told by Supervisor Collins to pick up the Local Law for Large Gatherings and the appropriate application for the Race Track Law from the Clerk.
Minutes of the August 11th meeting were reviewed by the Board and corrected.
M-98 Clm. Cobler moved and was seconded by Clm. Dougherty to accept the minutes as corrected. Vote – 5 ayes and 0 nays.
Supervisor's Monthly Report, Town Clerk's Monthly Report and the Monthly Dog Report were presented to the Board and filed with the Clerk.
C-13 Supervisor Collins announced the Board of Directors of the Tioga County REAP has laid off their Executive Director Martha Brennan due to lack of funds. Clm. Cobler stated that REAP is still waiting to hear about a Grant that was to be announced in June.
C-14 Supervisor Collins received a copy of the 2010 workers' compensation billing report from the Benefit's Office of Tioga County. Supervisor Collins stated that the Fire Department also falls under this Self Insurance Plan and stated that all claims this year were from the Highway Department.
C-15 Supervisor Collins received a letter of suggestions from the TING (Tioga Investigates Natural Gas) group on what the local governments can do regarding gas drilling.
C-16 COG (Council of Governments) sent an Excel chart showing the 2009 TCCMHIP collections and payments for the period of January 2009 – August 2009 that were billed to Excellus Blue Cross Shield. An estimated 25% increase may be in the future for Health Insurance.
C-17 State of New York Unified Court System requires that Town and Village Justices provide their court records to the auditing boards then forward the report to the NYS Office of Court Administration along with the resolution acknowledging that it was conducted. Clm. Cobler did the 2007 Audit.
C-18 Mr. Donald Weber Real Property Analyst for the State of New York sent Supervisor Collins a thank you letter for allowing him to come and talk at our Town Board regarding the equalization rate process and real property tax administration.
Highway Superintendent Kevin Noble added three pieces of equipment that was not included on the equipment inventory. Superintendent Noble suggested on-line auction for the Patch Truck in which we could set a reserve amount and stated there is no commission taken, the company makes their money on the buyers end.
M-99 Clm. Bish moved and was seconded by Clm. Cobler to sell the Patch Truck on-line with a reserve of $5,000. Vote 5 ayes and 0 nays.
Superintendent Noble gave an update on the roads that have been oiled and stoned. Stated the stones stored on Mr. Doucett's property is enough to finish a few more jobs, then the supply will be depleted.
Supervisor Collins has heard some criticism about us supplying our excavator to help the Fire Department. He informed the Board and the Public that it is our duty when it comes down to the health and safety of the people.
Code Enforcement Officer James Douglas was absent but turned in his monthly report and a transfer of a Mobile Home Park, which is situated, on Park Settlement Rd that needs Board approval.
M-100 Supervisor Collins moved and was seconded by Clm. Bish to allow the transfer of the Mobile Home Park license. Vote 5 ayes and 0 nays.
Clm. Dougherty and Clm. Cobler worked together on the Code Enforcement Officer's job description. A few things were added like Veterans Day off and bereavement leave. Mr. Douglas agreed with the contract. The Town Supervisor and the Code Enforcement Officer will sign the new agreement.
M-101 Clm. Dougherty moved and was seconded by Clm. Cobler to have a resolution to adopt the contract for the Code Enforcement Officer affected 9-8-09. Vote 5 ayes and 0 nays.
Resolution No. 01-09
Whereas: The Town of Candor wishes to enter into an updated contract with the Code Enforcement Officer and
Whereas: It is the wish of the Town that this contract include all job duties including those that reach outside the parameter of the traditional CEO job description and
Whereas: The Code Enforcement Officer Committee has developed a contract that covers the desired items
Therefore Be It Resolved: That the Candor Town Board adopt the new contract.
Candor Alternative School has requested the use of the Town Hall parking lot as a potential evacuation point for the faculty and students in case of an emergency. They would also like to reciprocate the offer by extending the use of the Alternative School to the Town in the event that the Town Hall comes under threat of an emergency or crisis.
M-101 Clm. Bish moved and was seconded by Clm. Lindsay to accept the School proposition for the use of the parking lot in case of an emergency and the use of the School to the Town Hall. Vote – 5 ayes and 0 nays.
Supervisor Collins stated we are in need of appointing a Tioga County Emergency Management person to replace Ex- Clm. Travis. Supervisor Collins asked Clm. Dougherty if he would be the contact person.
M-102 Clm. Bish moved and was seconded by Clm. Lindsay to appoint Milton Dougherty as the contact person for the Tioga County Emergency Management. Vote – Supervisor Collins-aye, Clm. Bish-aye, Clm. Lindsay-aye, Clm. Cobler-aye and Clm. Dougherty-abstained.
M-103 Clm. Bish moved and Clm. Lindsay seconded to adjourn the regular meeting at 8:15pm.
