Candor Town Board Meeting September 14, 2010The Candor Town Board met at the Town Hall, 101 Owego Road. Supervisor Darlene Cobler called the meeting to order at 7:00pm with pledge to the flag followed by Clm. Milton Dougherty offering a prayer. Present: Supervisor Darlene Cobler, Clm. Joseph Bish, Clm. Milton Dougherty, Clm. Dan Lindsay and Clm. George Williams. M-93 Clm. Williams moved, seconded by Clm. Bish to accept the minutes of August 24, 2010 as presented. Vote-Cobler-aye, Bish-aye, Dougherty-aye, Lindsay-aye and Williams-aye. Court Clerk Lynn Craig submitted an article on Who is Responsible regarding damages done to mailboxes during the winter months of snow plowing. NYS Att. General has opined that "a property owner may not interfere with the removal of snow which is part of the proper highway maintenance". Bottom line Municipalities are not responsible for replacing mailboxes. Attorney Kurt Schrader has received two petitions challenging assessments on properties in the Town of Candor. Our contract stipulates that we will pay Att. Schrader over and above the annual fee for these services. Supervisor’s Monthly Report, Dog Control Report and Town Clerk’s Monthly Report for the month of August was presented to the Board and filed with the Clerk. Supervisor Cobler met with Bookkeeper Shirley Mayor to go over the work sheets on the preliminary budget. Court Clerk Lynn Craig received an extra computer through her Justice Grant. After reviewing the Town’s minutes, she offered it to our Bookkeeper which saved the Town from having to purchase one. Thank you Clerk Craig. M-94 Clm. Bish moved, seconded by Clm. Lindsay to purchase 3 Security Monitors not to exceed $2,000. Vote-Cobler-aye, Bish-aye, Dougherty-aye, Lindsay-aye and Williams-aye. M-95 Clm. Bish moved, seconded by Clm. Williams to authorize Clerk Kulze to purchase 3 file cabinets and a countertop to replace her front desk not to exceed $800. Vote-Cobler-aye, Bish-aye, Dougherty-aye, Lindsay-aye and Williams-aye. No petitions for public referendum were filed for the Mill Street Property so the Town can proceed with the closing. Attorney Schrader will be in contact with Attorney Awad. Clm. Lindsay requested a copy of Scott Smith & Son’s employee manual as a guide for the Town to go by. Assessor Spaulding informed Supervisor Cobler of the dog licensing changeover per State Real Property, Assessors will no longer handle dog damage claims. Supervisor Cobler stated attending the Planning Board meeting in which they reviewed Candor Law and Ordinances. They are looking for direction to remove the fee schedule and penalty rates from affected laws. Att. Schrader took the Laws to follow up on necessary changes. Highway Superintendent Kevin Noble stated the Catatonk Bridge has been ordered and his crew will be stone & oiling next week. M-96 Clm. Bish moved, seconded by Clm. Lindsay to allow Kevin Noble to bid the Hydraulic Excavator. Vote-Cobler-aye, Bish-aye, Dougherty-aye, Lindsay-aye and Williams-aye. Code Enforcement Officer James Douglas reported on the NYSERDA Grant and stated milestone one is complete. He also reported that a violation notice to the Coney’s has been sent out. Code Enforcement Officer Douglas thanked Att. Schrader for writing up the Hover Variance to Local law #1 of 1987. R-20 Clm. Williams moved, seconded by Clm. Bish to accept Alice Kruse’s resignation from Deputy Town Clerk. Vote-Cobler-aye, Bish-aye, Dougherty-aye, Lindsay-aye and Williams-aye. WHEREAS, Alice Kruse has tendered her resignation to the Town Board, and WHEREAS, the Town Board has accepted her resignation with regrets, and WHEREAS, it is necessary to appointment an individual to serve the remaining 2010 portion of Ms. Kruse’s appointment, and WHEREAS, the Board is in agreement with the appointment of Virginia Dawson to fill this position NOW THEREFORE BE IT RESOLVED: That Virginia Dawson be Appointed to serve as Deputy Town Clerk, Deputy Tax Collector, and Deputy Registrar for the remainder of the year 2010. M-97 Clm. Dougherty moved, seconded by Clm. Williams to give Court Clerk Craig permission to attend NYS Association of Court Clerks Annual Conference which is being held in Albany, New York October 10-13. Vote-Cobler-aye, Bish-aye, Dougherty-aye, Lindsay-aye and Williams-aye. General Government Claims#210-231 in the amount of $15,655.50 were audited by the Board. Highway Claims #183-212 in the amount of $32,934.87 were audited by the Board. M-98 Supervisor Cobler moved, seconded by Clm. Bish to go into Executive Session at 8:17 to discuss employment history of a particular person and land transaction. M-99 Clm. Bish moved, seconded by Clm. Williams to come out of Executive Session at 9:23pm. Vote: Cobler-aye, Bish-aye, Dougherty-aye, Lindsay-aye and Williams-aye. M-100 Clm. Bish moved, seconded by Clm. Lindsay to adjourn the regular meeting at 9:24pm.
