Candor Town Board Meeting August 11, 2009

The Candor Town Board met at the Town Hall, 101 Owego Road. Supervisor Terry Collins called the meeting to order at 7:00pm with pledge to the United States Flag and Clm. Milton Dougherty offered up prayer.

Present: Supervisor Terry Collins, Clm. Joseph Bish, Clm. Darlene Cobler, Clm. Milton Dougherty, Clm. Dan Lindsay and Attorney David Weber.
Others present: Code Enforcement Officer James Douglas, Highway Superintendent Kevin Noble, Town Clerk Connie Kulze, 15 people from the public and 4 Press Representatives.

Privilege of the floor: Sue Smith-Heavenrich took the floor reminding our Town Officials that she spoke to them last month asking them what they were doing to educate themselves on municipal issues relating to the gas drilling. She mentioned several things that our Town could do now that did not require cooperation with other municipalities. This included a list of sensitive areas, road inventory, a meeting with the Fire Commissioners, Candor EMS and the School Board. Mrs. Smith-Heavenrich mentioned the Envirothon Team or Participation in Government students here at Candor High might be interested in helping out with this. She also came up with another good idea involving Jon Benjamin's Video Technology Class and students who are seeking their Eagle and First Class Scouting Awards. Mr. Collins thanked her for her suggestions.

Privilege of the floor: Frank Cook asked the Town Board about Benton Road becoming a Town Road again. Supervisor Collins stated this was on the Agenda later in the meeting under Old Business and that he could take the floor at that time.

Minutes of the July 28 meeting were presented to the Board and corrected.
M-93 Clm. Dougherty moved and was seconded by Clm. Cobler to accept the minutes as corrected. Vote – 5 ayes and 0 nays.

Supervisors Report, Dog Control Report and Town Clerks Report were presented to the Board and were filed with the Clerk.

Supervisor Collins reported receiving the final State equalization rate from the State Board of Real Property Services for the Town of Candor, which is 6.45 for the 2009 Assessment Roll. Supervisor Collins also stated that Mr. Don Weber from the State has been going around with Tax Assessor Denise Spaulding to verify inventory on properties in the Town of Candor.

Clm. Lindsay reported that there was no new progress on the Highway Complex Committee.

Clm. Cobler stated that the Old School Book that she was going to scan is too fragile and suggested donating it to the County Museum. After discussion, it was decided that the book be given to the Candor Historical Society. Clm. Dougherty stated that he would contact Bob Snyder who originally wanted to scan it.
M-94 Clm. Bish moved and was seconded by Clm. Cobler to donate the Candor School Book to the Candor Historical Society. Vote 5 ayes and 0 nays.

Supervisor Collins brought up the Benton Road issue. Code Enforcement Officer Douglas spoke of the property that Frank Cook and Jeff Rockwell bought from the Village of Candor, which is located on Benton Road with no deeded right away. Officer Douglas voiced that he cannot issue a building permit with no access to a year around road. Mr. Richard VanScoy owns Benton Road, which was declared abandoned by the Town of Candor in 1964. Mr. VanScoy has no desire to give it back to the Town. It was decided that Mr. VanScoy and Mr. Cook get together and maybe come up with a plan for a right away. Attorney Weber will be looking into the matter of a building permit issued on a property with a right away.

Kevin Noble Candor's Highway Superintendent reported there are several major repairs or purchases coming up. He mentioned the 1990 Kobelco Excavator sub frame for under carriage is shot. 1994 Cat Excavator has multiple electrical problems. The 1999 and 2001 Ten Wheelers are both coming up for replacement. Two 1998 Pick Up Trucks have well over 150,000 miles. Mr. Noble stated that the Track Excavator, which is a primary piece of equipment, starts around $200,000 and there is only $123,000 left in the budget. Mr. Noble also informed the Board that they have 300 Tons of salt left to purchase under their agreement. They are out of storage space but with purchasing it now they will save $1.50/ton and will be able to cover it with tarps. The salt will be delivered the 2nd or 3rd week in September. The company has agreed to work with Kevin on the actual amount left to purchase under their agreement.

Code Enforcement Officer James Douglas submitted his monthly report to the Board and it is filed with the clerk. He stated the porch permit has been deleted due to lack of funds. Other than that all is going well.

Supervisor Collins received a letter from a Mr. George Butts who has been busy doing genealogy on his family. He and the Candor Town Clerk discovered that the information on the West Candor Cemetery has an error. His Great Great Great Grand Father Bissell Woodford is reported in our 1835 book as Russell Woodford. Later this fall he intends to clear the lilac bushes, which surround the Bissell's stone, and has requested the stones remain cleared of detrimental growth.

Supervisor Collins spoke of a petition that was filed seeking judicial review of a tax assessment. This included 2 Cell Towers and the Weltonville Trailer Park.

Supervisor Collins reported receiving a letter from the Census Bureau thanking him for his response on the homelessness in the Town of Candor, for which he never responded.

M-95 Clm. Bish moved and Clm. Lindsay seconded to adjourn the regular meeting at 8:02pm.
