Candor Town Board Meeting July 14, 2009

The Candor Town Board met at the Town Hall, 101 Owego Road. Supervisor Terry Collins called the meeting to order at 7:00pm with pledge to the United States Flag and Clm. Milton Dougherty offered prayer.

Present: Supervisor Terry Collins, Clm. Joseph Bish, Clm. Darlene Cobler, Clm. Milton Dougherty, Clm. Dan Lindsay and Attorney David Weber.
Others present: Code Enforcement Officer James Douglas, Highway Superintendent Kevin Noble, Town Clerk Connie Kulze, 10 people from the public and 3 Press Representatives.

Privilege of the floor: Roy Yarrington took the floor asking the Town Board to pay for the purchase of Mariette Seamon’s plaque which will be placed at the base of the tree that was planted in memory of her. The cost of the plaque is $225. Clm. Dougherty tabled this until later in the meeting.

Privilege of the floor: Howard Leonard addressed the Board with questions regarding abandoned roads being gated and locked. Attorney Weber spoke of the 1964 Resolution, which was put into place regarding abandoned roads. Supervisor Collins suggested Mr. Leonard see the Clerk and get a list of Candor’s Abandoned Roads for further reference.

Privilege of the floor: Sue Heavenrich spoke to the Board regarding the meetings she has attended that focus on actions towns can take to protect their infrastructure as gas drilling activities get closer. She stated that see has seen no familiar faces from the Candor Town Council and feels that our Town needs to be more involved. Sue also informed the Board and the public about a web site we can access to get a legal & practical guide to protecting your citizens.

Minutes of the June 23rd meeting were presented and reviewed by the Board.
M-84 Clm. Dougherty moved and was seconded by Clm. Cobler to accept the minutes as presented. Vote – 5 ayes and 0 nays.

C-11 Tioga County Fitness Challenge informed us that there will be a Bike Race in Candor on August 8th, starting at the Candor Fire Station. Registration will be from 8-9:00am with the first biker out at 8:30am. The race will benefit Candor Fire Auxiliary and Candor TOPS Chapter who are non-profit organizations.

Supervisor’s Monthly Report, Town Clerk’s Monthly Report, Code Enforcement Officer’s Report and the Monthly Dog Report were presented to the Board and filed with the Clerk.

Clm. Lindsay commented that the Highway Complex Property Committee has still been meeting.

Highway Superintendent Noble received quotes from Mark Lisak Construction and It’s Now or Never for sealing the cracks in the parking lot and driveway at the Town Hall.
M-85 Clm. Bish moved and was seconded by Clm. Lindsay to give permission for Mark Lisak Construction to do the job for $800. Vote – 5 ayes and 0 nays.

Supervisor Collins wanted to remind the Board and the Public of Mr. Don Weber from NYSORPS will be speaking on equalization rates at our next meeting.

The matter of annual advertising with the local papers was brought up again. With the Town paying for a website this year Clm. Lindsay felt it was more than sufficient for this year.

Superintendent Noble stated he had a crash course on his new computer program. Also stated the Sterling/Henderson 10 Wheeler has a severely broken box which is made of stainless steel and that the truck was up in Watertown getting fixed. He felt that it would be worthwhile for him to make a trip there to see how things were going with it.

Works Tioga was inquiring about our future interest in working with them again they contacted Superintendent Noble and also informed him that the gentleman that had worked for the Town had found a job. Board agreed to look at each case and what work could be done.

A stone, which flew from a Town Mower hit a car and dented it. At this time we do not know how much damage was done. There was a question whether to pay for the damage out right or submit to the insurance company. It was decided that it should be turned in to the Insurance Company regardless.

Code Enforcement Officer Douglas received a letter from Tioga Opportunities thanking the Town for waiving the building permit fees to the 2009 Angel Action Group Work camps. This group does home repair for the elderly, disabled and low-income families in our county at no cost to them. Douglas also informed the Board he would be taking several classes in the near future. All are credit hour classes. Mr. Douglas also wanted to thank the Tioga County Sheriffs Office for assisting him with a dog issue over the weekend.

M-86 Clm. Dougherty moved and was seconded by Clm. Cobler to allow Court Clerk Lynn Craig to apply for the JCAP Grant. Vote – 5 ayes and 0 nays.

M-87 Clm. Dougherty moved and was seconded by Clm. Cobler for the Town to pay for Mariette Seamon’s plaque in the amount $225. Vote – 5 ayes and 0 nays.

Attorney Weber questioned the Board about the extent of his involvement with the gas & oil sessions. He stated he has been involved with other Town Attorneys and the County Attorney working with the Broome County law. He thought it might be a good idea to contact Sullivan County to see what they have accomplished. Attorney Weber will be working on this.

M-88 Clm. Bish moved and Clm. Lindsay seconded to adjourn the regular meeting at 8:07pm.
