Candor Town Board Meeting June 8, 2010
The Candor Town Board met at the Town Hall, 101 Owego Road. Supervisor Darlene Cobler called the meeting to order at 7:00pm with pledge to the flag followed by Clm. Milton Dougherty offering a prayer.
Present: Supervisor Darlene Cobler, Clm. Joseph Bish, Clm. Milton Dougherty, Clm. Dan Lindsay and Clm. George Williams.
Others present: Attorney Kurt Schrader, Highway Superintendent Kevin Noble, Code Enforcement Officer James Douglas and Town Clerk Connie Kulze.
Guest: 5 people from the public and 1 Press Representative.
Supervisor Cobler commented that the tour of different gas well sites on June 3rd was postponed to a future date.
M-60 Clm. Dougherty moved, seconded by Clm. Williams to accept the Minutes of May 25, 2010 Town Board Meeting as presented. Vote: Supervisor Cobler-aye, Clm. Bish-aye, Clm. Dougherty-aye, Clm. Lindsay-aye and Clm. Williams-aye.
On May 27th we received a call regarding a dog bite incident; Supervisor Cobler and Code Officer Douglas responded. The gentleman went to the hospital after receiving 13 bites from 2 Pit bulls. The dogs were held for 10 days in the town kennel. On June 7th Judge Dence ordered the dogs to be euthanized, the procedure happened at 2:00 the same day, with the expense to fall on the owners.
Monthly reports from the Supervisor, Town Clerk and Dog Control were presented to the Board and filed with the Clerk.
Supervisor Cobler contacted the County regarding the State not paying State Land Tax; they were quite disturbed to hear this. The County is looking into the matter along with Assessor Spaulding and Supervisor Cobler staying on top of it all.
Clm. Bish reported on the Highway Committee that he attended a meeting along with the Village, School, Fire Company and Ambulance Crew regarding the bridge replacement which is located in the Village of Candor. They all agreed that we should have a pedestrian walk way and utilizing the upper bridge while the lower bridge is being replaced.
Superintendent Noble stated that the CHIPS have been approved by the House and the Senate and the Governor was supposed to sign it today. Superintendent Noble also commented on receiving a letter that Mr. Raymond Maratea decided not to have the work done to his drive at this time.
Code Enforcement Officer Douglas filed his monthly report with the Clerk. He also stated there were no updates on the NYSERDA solar grant. Weltonville Fire Company’s site plan was reviewed and approved for new construction. The Candor Fire District is establishing an Auxiliary Site to house a fire truck in the Willseyville area for faster response time. It will be housed at the DOT building on Ithaca Rd. and will also reduce fire insurance for the Willseyville residents. Code Officer Douglas also requested purchasing supplies to have on hand at the Town’s Kennel and also requested attending training classes with the Dog Control Officers, which will be mandated by the State in July of 2011.
M-61 Clm. Dougherty moved, seconded by Clm. Bish to approve Code Officer Douglas to purchase the proper equipment for dealing with dog cases within the town. Vote – Supervisor Cobler-aye, Clm. Bish-aye, Clm. Dougherty-aye, Clm. Lindsay-aye and Clm. Williams-aye.
The Board discussed the Town Historian Carol Henry having an access code to enter the Town Hall. After much discussion the Board decided to allow Carol Henry access.
CGR interviews with Town employees took place here at the Town Hall gathering information and facts on the dissolution of the Village. Supervisor Cobler stated she has been sitting in on the committee meetings and mentioned she is an Adhoc Member who does not participate vocally.
Supervisor Cobler attended the Planning Board Meeting in which Mr. Robert Aman spoke out on the Catatonk Creek Aquifer and his concerns. Supervisor Cobler received an e-mail from Steven Winkley who is the Source Water Protection Specialist who has been collecting data and suggested designating the Catatonk Creek Aquifer as a Critical Environmental Area (CEA) which would include the Village and Town of Candor.
Closing Privilege of the Floor: Planning Board Member Matt Crowe requested direction from the Town Board as to whether the Planning Board should pursue zoning. After discussion Board Members were asked for their opinion. A majority of the Board expressed that they had no interest in pursuing zoning at this time.
M-62 Supervisor Cobler moved, seconded by Clm. Lindsay to go into Executive Session at 7:55pm to discuss the purchasing property, selling Mill Street property and the employment history of a particular employee. Vote: Supervisor Cobler-aye, Clm. Bish-aye, Clm. Dougherty-aye, Clm. Lindsay-aye and Clm. Williams-aye.
General Government Claims #132-157 in the amount of $8,021.20 were audited by the Board. Highway Claims #108-133 in the amount of $58,956.89 were audited by the Board.
M-63 Clm. Dougherty moved, seconded by Clm. Lindsay to go out of Executive Session at 9:05.
M-64 Clm. Bish moved, seconded by Clm. Lindsay to adjourn the regular meeting at 9:06pm.
