Candor Town Board Meeting May 12, 2009
The Candor Town Board met at the Town Hall, 101 Owego Road. Supervisor Terry Collins called the meeting to order at 7:00pm with pledge to the United States Flag and Clm. Milton Dougherty offered prayer.
Present: Supervisor Collins, Clm. Bish, Clm. Cobler, Clm. Dougherty and Clm. Lindsay
Others present: Code Enforcement Officer James Douglas, Highway Superintendent Kevin Noble, Town Clerk Connie Kulze, 11 people from the public and 2 Press Representatives.
Privilege of Floor: Supervisor Terry Collins made an official announcement that he will not be running for another term. He stated that he has enjoyed his position as Supervisor but feels that 12 years is enough.
Privilege of Floor: Hank Ferris took the floor with questions regarding the Darlington Case and money that Eric Halstead owes the Town of Candor. Supervisor Collins commented that the Darlington case is in the hands of the Court Judge and hopefully will be settled within 60 days. Supervisor Collins also stated that if we back down from this case that it could affect the whole state of New York not just the Town of Candor. In regards to the money owed by the previous Highway Superintendent Eric Halstead, Collins stated that it would cost the Town in attorney fees as much as he owes and felt we should just put it behind us with a lesson learned.
Privilege of Floor: Village Mayor Steve Sparling thanked the Board for their support of the Highway crew in placing the barriers in front of the Gator's Pub for public safety. He also asked permission for the barriers to remain in place until further work is done with the Village assisting in any way.
Privilege of Floor: Matt Crowe took the floor in thanking the Town Board and the Highway Department for their participation in the roadside clean up. He also stated that it was very much appreciated.
Minutes of the April 28th meeting were presented and reviewed by the Board.
M-66 Clm. Dougherty moved and was seconded by Clm. Cobler to accept the minutes as presented. Vote 5 ayes and 0 nays.
C-6 Supervisor Collins received a thank you letter from Governor Paterson for his participation in the Economic Recovery program and his kind words of support. Supervisor Collins got a chuckle for he did not even go to the meeting.
Supervisor's monthly report, Town Clerk's monthly report and Dog Control monthly report was presented to the Board and filed with the Clerk.
Clm. Cobler gave a brief update on the Website in which she stated that it would be live on May 31, 2009 for the public to view. Also gave the website address which is candorny.us.
ATV Club roadside pickup was a success. They covered several roads within the Town of Candor and our Highway Department took care of the bags and debris, which totaled over 2 tons.
Tire program once again will be happening this year with tentative dates of June 4th – June 5th from 8:00am – 4:00 pm and June 6th from 8:00am – 12:00pm. The Works Tioga helped last year with sending people over to work and hopefully will help again this time. Clerk Kulze will be in contact with Ellen Pratt who is with the Tioga County Solid Waste to confirm dates and time.
Supervisor Collins spoke to the public regarding the abandoned road issue and stated that the Town was not going to pursue the matter.
Highway Superintendent Kevin Noble spoke on the official letter he received from New York State Department of Transportation regarding the Consolidated Highway Improvement Program (CHIPS) and was pleased to announce that it included an extra $45 from last year.
Kevin Noble also gave a report on the garage doors, which are completed and commented the job was well done. Also brought up a computer program, which he and Clm. Bish have been looking at, that track several things including personnel, materials and equipment inventory. Superintendent would like permission to purchase the program.
M-67 Clm. Cobler moved and was seconded by Clm. Bish to authorize Superintendent Kevin Noble to purchase the computer program for the Highway Department. Vote – 5 ayes and 0 nays.
Superintendent Noble commented on the Weltonville guardrail issue. He stated that a person from the public took it upon himself to remove the railing, which is now a safety and a liability issue for the Town. Superintendent Noble has spoken to the gentleman and our Town Attorney David Weber has written him regarding the consequences of his actions. Supervisor Collins along with the Board told Superintendent Noble to go ahead and put the railing back up and to notify the Tioga County Sheriff of the time and date when the work will take place.
With many thanks going out to Clm. Dougherty for all your hard work our gas supplier will be changed from U.S. Gas & Electric, Inc. to NYSEG Solutions, Inc. as of June 2, 2009 with a fixed rate. Clm. Dougherty will also be requesting a lock on the account that will prevent another supplier from switching our account without the permission of the Town Board.
C-7 Candor Fire Department has inquired about access to water ways by abandoned bridges on South Kelsey and West Candor Roads. The Board suggested them asking the landowners about access paths large enough for the fire trucks to get to the water and the Town agreed to supply the gravel for the ramps. Supervisor Collins will be back in touch with them.
Code Enforcement Officer James Douglas presented his monthly report to the Board and was filed with the Clerk.
Enforcement Officer Douglas had several items for the Board to review. A violation notice was given to Hidden Valley Park in Weltonville with 9 different violations. He also requested a refund be made to Gary Hollenbeck for a Site Plan Review. Mr. Hollenbeck applied for a permit application for a commercial business, with further investigation it was determined it was not necessary.
M-68 Supervisor Collins moved and seconded by Clm. Cobler to refund $100 to Gary Hollenbeck for the Site Plan Review. Vote – 5 ayes and 0 nays.
Enforcement Officer Douglas asked permission to attend STBOA Quarterly Meeting and Training June 10 in Horseheads, New York along with a STBOA Training Session on June 24th in Dryden, New York.
M-69 Clm. Bish moved and seconded by Clm. Cobler to allow James Douglas to attend the training sessions in Horseheads and Dryden. Vote – 5 ayes and 0 nays.
M-70 Clm. Bish moved and Clm. Lindsay seconded to adjourn regular meeting at 8:04pm.
