Candor Town Board Meeting April 14, 2009

The Candor Town Board met at the Town Hall, 101 Owego Road. Supervisor Terry Collins called the meeting to order at 7:00pm with pledge to the United States Flag and Clm. Milton Dougherty offered prayer.

Present: Supervisor Collins, Clm. Dougherty, Clm. Bish, Clm. Lindsay and Clm. Cobler Others present: Code Enforcement Officer James Douglas, Highway Superintendent Kevin Noble, Town Attorney David Weber, Town Clerk Connie Kulze, 18 people from the public and 2 press representatives.

Privilege of the Floor: Mr. Fred Quinlan speaking for the Tioga Men's Garden Club would like to plant a tree in honor of Mariette Seamon who was Town Clerk from 1974- 1989. The Candor Community Service Organization will donate a plaque. The planting will take place on April 24th at 1:OOpmhere at the Town Hall.

M-55 Clm. Dougherty moved and seconded by Clm. Cobler to allow the Tioga Men's Garden Club to plant the tree in honor of Mariette Seamon. Vote 5 ayes and 0 nays.

Privilege of the Floor: Lynn Craig, Peter Pappas, Bob Houck and Ken Strickland all took the floor at separate times expressing their disappointment and concern with Aaron Gowan's decision to close off the abandoned part of Ketchum Hollow Road and Norris Road in the Town of Candor. They addressed different situations that could arise if the roads were not accessible for instance with emergency vehicles. Others have land that is accessed by these roads and others use it for recreational purposes.

Supervisor Collins thanked the public for their input and stated that the Town Attorney is looking further into the matter for it is a legal case.

Clm. Cobler read portions from the Town Law that state clearly the definition and time line of individuals to site a complaint with the Town for abandoning roads (one year). She also stated that closing these abandoned roads does not leave any property land locked.

Minutes of the March 24th meeting were presented and reviewed by the Board. M-56 Clm. Dougherty moved and was seconded by Clm. Cobler to accept the minutes as presented. Vote - 5 ayes and 0 nays.

Supervisors report, dog control report, code enforcement report, historian's annual report and the clerks monthly report were presented to the board and filed with the clerk.

The Board received a list of the Planning Board Members and the agenda for Tioga County Council of Governments.

Supervisor Collins asked Clm. Lindsay how the Highway Complex Property Committee was doing. Lindsay stated they have gotten together, have done some research, created a wish list and implied that it would take some time. Clm. Lindsay will keep us informed.

Supervisor Collins asked Clm. Cobler for an update on the new Web Site. Clm. Cobler voiced that it was making good progress and she had gotten a few pictures already.

Supervisor Collins stated that the Local Attorneys were meeting on April 15th to discuss the Road preservation law.

M-S7 Supervisor Collins moved and was seconded by Clm. Cobler that the Town of Candor hosts a tire program as they have done in the past. Vote - 5 ayes and 0 nays.

Superintendent Kevin Noble spoke on the Annual Maintenance Permits that the State requires by municipalities. Kevin recommended that we go with PERM 1 and asked to have the form signed by the Town Supervisor to submit it. Our Municipality would need to pass a resolution and send it to NYSDOT.

M-S8 Clm. Bish moved and was seconded by Clm. Lindsay to approve Supervisor Collins to sign the PERM 1 agreement with DOT. Vote 5 ayes and 0 nays.

l-Ton Dump Truck was on display in the parking lot for all to see.

M-S9 Clm. Bish moved and was seconded by Clm. Lindsay to sell the pick-up truck to George Swansborough for $1,400. Vote 5 ayes and 0 nays.

Superintendent Noble stated he would be working on filling the holes in the parking lot at the Fire Department. Also stated that the gravel pit in Catatonk is opened now and that they have applied for the driveway permit.

Code Enforcement Officer James Douglas reported that things are picking up with the change in the weather. Did receive a complaint from an owner who lives near where the Highway Dept is storing their stone on Spencer Rd. Was informed that all was legal.

Supervisor Collins received a letter from Congressman Michael Arcuri on the Federal Highway Bill, which asked if we had any projects that we would like funded.

Between April and July of 2009, U.S. Census employees will be visiting every neighborhood in our community in order to gather information to conduct the 2010 Decennial Census. We have posted this on the bulletin board to help inform the public.

Supervisor Collins granted Ken Strickland permission to speak, in which he asked why the Town Minutes were not posted. Clm. Cobler replied that they would be put on the WEB Site once they are accepted.

M-60 Supervisor Collins moved to go into Executive Session at 7:55pm for the purpose of discussing ongoing litigation and Clm. Bish seconded it. Vote 5 ayes and 0 nays.

M-61 Clm. Bish moved and seconded by Clm. Cobler to go out of Executive Session at 8:23pm and to adjourn the regular meeting at this time also. Vote 5 ayes and 0 nays.
