Candor Town Board Meeting April 13, 2010
The Candor Town Board met at the Town Hall, 101 Owego Road, Supervisor Cobler called the meeting to order at 7:00pm with pledge to the flag and Clm. Milton Dougherty offered prayer.
Present: Supervisor Darlene Cobler, Clm. Joseph Bish, Clm. Milton Dougherty, Clm. Dan Lindsay and Clm. George Williams.
Others present: Attorney Kurt Schrader, Code Enforcement Officer James Douglas, Town Clerk Connie Kulze and Highway Superintendent Kevin Noble.
Guest: 6 people from the public and 2 Press Representatives.
Privilege of the floor: Jason Kraus addressed the Board on behalf of the Candor's 4 Wheeler Club having a Road-side Clean-up Day. The Candor Highway Department offered to pick up the trash bags for disposal.
Supervisor Cobler addressed the public regarding a couple issues. #1} Would like to see different people taking closing privilege of the floor from opening privilege. #2} Wanted the public to know that there have been NO secret meetings held that would be contrary to Open Meeting Law. #3} Workshops will be posted ahead of time. #4} Addressing Christine Curkendall-the conference call she suggested would breach the Open Meeting Law. #5} Website input will remain the same for it is no cost to the public.
M-42 Supervisor Cobler moved, seconded by Clm. Bish to go into Executive Session at 7:12pm to discuss land acquisition and the employment history of a particular person. Vote -Cobler-aye, Bish-aye, Dougherty-aye, Lindsay-aye and Williams-aye. Attorney Schrader and Superintendent Noble were asked to join them.
M-43 Clm. Bish moved, seconded by Clm. Lindsay to come out of Executive Meeting at 7:36. VoteCobler-aye, Bish-aye, Dougherty-aye, Lindsay-aye and Williams-aye.
M-44 Clm. Dougherty moved, seconded by Clm. Williams to accept minutes as presented. VoteCobler-aye, Bish-aye, Dougherty-aye, Lindsay-aye and Williams-aye.
C-5 Southern Tier Microd Club of Candor turned in their schedule and contact information.
C-6 Supervisor Cobler received an e-mail complaining about the noise from ATV's and Dirt bikes and questioning regulations regarding use/noise.
Town Supervisor's report, Dog Control report and the Town Clerk's monthly report was reviewed by the Board and filed with the Clerk.
Resolution for Retirement System was tabled again and will be discussed at the next meeting.
Money has been received from the Justice Grant totaling $5J52.49.
Highway Committee -Chair Clm. Bish reported things are running smoothly at the Highway Barn, the accounts are well in balance and roads are looking pretty good.
Cemetery Committee -Chair Clm. Williams reported finding possible contract formats and should have more information for the next meeting.
RUA Update -Supervisor Cobler mentioned bond, escrow or a combination of both need to be addressed and road maintenance while the project is ongoing. Approximately 90% of the Road Use Agreement is done.
Privilege of the floor -Christine Curkendal took the floor regarding the RUA and wondered if there were any questions from the Board that she could answer. There were none.
Supervisor Cobler reported attending DOT meeting regarding the Catatonk Creek Bridge located in the Village of Candor held at the school on March 24th which addressed 3 options. #1} Too expensive, #2} 2 year plan -replacing one lane at a time, #3} 1 year plan which would totally take out the bridge but would supply a pedestrian walk way. Construction work to be started in 2013 depending on funding.
Supervisor Cobler also attended the Susquehanna River Basin Commission Meeting, County Natural Gas Task Force Forum and the Tioga Co. Annual BC/BS Utilization Review Meeting.
Superintendent Noble reported the new 10 Wheeler is in and is here at the Town Hall for all to check out. Also stated the screener motor is shot, to repair it would cost around $5,000. Superintendent Noble has received 3 different quotes for a new screener. MidAtlantic Engines coming in at $7,710, Rudocks Engine and Steam -$7,580 and RA Mitchell at $7475.
M-45 Clm. Bish moved, seconded by Clm. Lindsay to permit Superintendent Noble to purchase a new screener from RA Mitchell for $7475 but not to exceed $8,900. Vote -Cobler-aye, Bish-aye, Dougherty-aye, Lindsay-aye and Williams-aye.
M-46 Clm. Bish moved, seconded by Clm. Lindsay to allow Superintendent Noble to attend a 3 day Highway School held at Cornell University in Ithaca, New York for $90. Vote -Cobler-aye, Bish-aye, Dougherty-aye, Lindsay-aye and Williams-aye.
M-47 Clm. Lindsay moved, seconded by Clm. Bish to auction off the 10 Wheeler through Teetsworth Auction Service with a reserve of $35K. Vote -Cobler-ave, Bish-aye, Dougherty-aye, Lindsay-aye and Williams-aye.
Code Enforcement Officer James Douglas presented his monthly report to the Board and is filed with the Clerk. Mr. Douglas updated the Board on the NYSERDAGrant status; he also mentioned the EPA Lead Contractor Certification Program and an application to transfer Crimson Court Mobile Home Park.
M-48 Clm. Williams moved, seconded by Clm. Lindsay to allow the transfer of Crimson Court Trailer Park from James Morse to Phil and Robin Beebe. Vote -Cobler-aye, Bish-aye, Dougherty-aye, Lindsay-aye and Williams-aye.
Supervisor Cobler announced that our Insurance Policy is in if anyone would like to review it.
M-49 Supervisor Cobler moved, seconded by Clm. Bish to allow $300 for clothing allowance for the Highway Superintendent per year to be paid out quarterly. Vote -Cobler-aye, Bish-aye, Dougherty-aye, Lindsay-aye and Williams-aye.
General Government Claims #111- 113in the amounts of $ 4,114.98 were audited by the Board. Highway Claims #87-107 in the amount of $15,070.57 were audited by the Board.
M-50 Clm. Bish moved, seconded by Clm. Lindsay to adjourn meeting at 8:21pm.
