Candor Town Board Meeting March 24, 2009

The Candor Town Board met at the Town Hall, 101 Owego Road. Deputy Supervisor Dougherty called the meeting to order at 7:00pm with pledge to the flag and Clm. Cobler offered prayer.

Present: Deputy Supv. Dougherty, Clm. Bish, Clm. Lindsay and Clm. Cobler. Supv. Collins was excused from the meeting.
Others present: Code Enforcement Officer James Douglas, Highway Superintendent Kevin Noble, Town Clerk Connie Kulze, 7 people from the public and 2 press representatives.

Privilege of the Floor: Aaron Gowan addressed the Board on the subject of abandoned roads that run through his property. He informed the Board that he has gated and locked Ketchum Hollow and Powers roads. He stated that he has spent $20,000 fixing these roads for his own use and does not want the public using them without his permission and that the Sheriff s Dept. and State Police have been informed of the no trespassing requirement. He reminded the Board that a letter had been sent to the Town Attorney in 2007 requesting a quitclaim deed for these roads.

Minutes of the March 10th meeting were presented and reviewed by the Board.
M-47 Deputy Supv. Dougherty moved with a second by Clm. Cobler to accept the minutes as presented. Vote - 4 ayes and 0 nays with 1 absent.

Supervisor's monthly report was presented to the Board and filed with the Clerk.

C-3 Tioga County Legislators have decided to keep the distribution of sales tax to towns and villages on a monthly basis. For convenience and cost effectiveness they will be distributing the money to us electronically.

Tioga County would like to reword the Memorandum of Understanding for Municipal Cooperation in Condemnation Proceedings. Deputy Supv. Dougherty gave copies of their concerns to the Board and stated the matter should be discussed among the Towns! attorneys.

Clm. Cobler gave an update on the Town Web Site progress. Stated she gathered information working with Mike Hollenbeck he will charge $20/hour. Clm. Cobler requested permission to go ahead with the project not to exceed $1500. Cobler also contacted Mayor Sparling of the Village, in which he expressed their interest in forming a link to the site for Village information. Clm. Cobler will be contacting individuals for specific input desired.

M-48 Clm. Bish moved and seconded by Clm. Lindsay to authorize Clm. Cobler to proceed with the website construction and not to exceed $1500. Vote - 4 ayes and 0 nays, with 1 absent.

Deputy Supv. Dougherty and Highway Superintendent Noble met with Dennis Rose the owner of Punk's Place, in which they discussed the Town Property line, parking lot and the stones which divide the two. Rose would like to increase the parking for the establishment and has permission to use the area between his property line and the Town Park. Further investigation is in the works.

Highway Superintendent Noble presented the Agreement made between Town of Candor and James and Stephanie Doucett regarding the land use for the gravel storage.

M-49 Deputy Supv. Dougherty moved and seconded by Clm. Bish to accept the agreement between Town of Candor and James and Stephanie Doucett. Vote - 4 ayes and 0 nays with 1 absent.

Highway Superintendent Noble also stated that he had not received any bids for the Ford Pick-up Truck. Only other alternative is to sell it for scrap.

New Dump Truck was delivered and on display for all to see.

Highway Superintendent Noble asked for permission to trade an excavator bucket for road signs with the Tioga County Highway Dept.

M-50 Clm. Bish moved and was seconded by Clm. Cobler to permit Highway Superintendent Noble to trade the excavator bucket for road signs with Tioga Cty. Highway Dept. Vote - 4 ayes and 0 nays with 1 absent.

M-51 Clm. Bish moved and was seconded by Clm. Cobler to give Highway Superintendent Noble permission to attend the 2009 Highway School which is sponsored by the Town and County Officers Training School and the Association of Towns of the State of New York from June 1-3,2009. Vote - 4 ayes and 0 nays with 1 absent.

M-52 Clm. Bish moved and was seconded by Clm. Lindsay to authorize Highway Superintendent Noble to pursue bids for a new roller. Vote - 4 ayes and 0 nays with 1 absent.

M-53 Clm. Bish moved and was seconded by Clm. Cobler to accept the County bids for aggregate, pipe and fuel. Vote - 4 ayes and 0 nays with 1 absent.

M-54 Clm. Bish moved and was seconded by Clm. Cobler to adjourn at 8:08pm.
