Candor Town Board Meeting March 23, 2010
The Candor Town Board met at the Town Hall, 101 Owego Road. Supervisor Cobler called the meeting to order at 7:02pm with pledge to the flag and Clm. George Williams offered prayer.
Present: Supervisor Darlene Cobler, Clm. Joseph Bish, Clm. Milton Dougherty, Clm. Dan Lindsay and Clm. George Williams.
Others present: Attorney Kurt Schrader, Code Enforcement Officer James Douglas, Town Clerk Connie Kulze and Highway Superintendent Kevin Noble.
Guest: 10 people from the public and 3 Press Representatives.
Privilege of the floor: Fred Martinez read to the Board a letter he had written regarding his disappointment of the Town Board in their involvement with the Road Use Agreement. He requested that the e-mails regarding the RUA be filed and given to the Clerk. Mr. Martinez also requested that the Town Clerk or the Town IT maintain the Town's Website.
M-38 Clm. Bish moved, seconded by Clm. Lindsay to go into Executive Session to discuss Land Acquisition at 7:12pm and requested that Superintendent Noble and Attorney Schrader join them. Vote – Cobler – aye, Bish – aye, Dougherty – aye, Lindsay – aye and Williams – aye.
M-39 Clm. Bish moved, seconded by Clm. Lindsay to come out of Executive Session at 7:42pm.
M-40 Clm. Dougherty moved, seconded by Clm. Lindsay to accept minutes as presented. Vote: Cobler-aye, Bish-aye, Dougherty-aye, Lindsay-aye and Williams-aye.
RPEA (Retired Public Employees Association, Inc.) will be holding a seminar April 15 for all employees who are considering retiring within the next three-five years.
Justice report for the Month of February was presented to the Board. Total amount collected was $6,712 with Candor's portion being $1,672.
DOT meeting will be at the Candor High School on March 24 with discussion on replacing the Lower Bridge.
Resolution for the Retirement System was tabled until next meeting.
Supervisor Cobler spoke on the 2010 Census and encouraged everyone to fill it out and turn it in for it determines how much money our municipality and the County gets. Supervisor Cobler also requested a report on the Buildings and Grounds and commented that mowing for the Town Hall needs to be considered along with the cemeteries. A copy of the Code of Ethics was passed out to the Board for their review.
The next Road Use Agreement Workshop will be held on April 5th at 6:00pm here at the Town Hall.
Supervisor Cobler attended a COG meeting and came back with information on Health Insurance and a new Workers Comp. Poster. There was also a presentation on childhood lead poisoning prevention by the County Public Health.
Susquehanna River Basin Commission Meeting will be held March 29th at the Hubbard Auditorium and the Natural Gas Task Force Forum will be held on March 30th in Sayre. Supervisor Cobler plans to attend both meetings.
TING members monitor the Oil & Gas Searchable Database on DEC's website for natural gas drilling permit applications and permit issuance dates. The gas companies do not notify the County when they intend to start drilling therefore TING would appreciate the Municipality Officers notifying the County of drill date knowledge.
Superintendent Noble announced a CPR Class held at the Ambulance Building on March 30th at 7:30pm which all Town Employees are mandated to take. Mr. Noble stated that typical damage had been done on the seasonal roads this winter, also reported breaking a lock tab on the Back Hoe. Asphalt and plastic pipe is going up in cost and Mr. Noble thought it would be in the best interest of the Town to stock pile some plastic pipe. Mr. Noble and Clm. Bish agreed to drop the salt order down this year based on consumption.
Code Officer Douglas reported things are picking up with the weather changing and presented to the Board information on documenting contamination of private wells done by the Gas Companies. Mr. Douglas highly suggested looking over the information he passed out.
Supervisor Cobler spoke with Oakey Teeter one of our cemetery mowers regarding this year's contract. Supervisor Cobler would like a Cemetery Committee Report for the next meeting.
Closing Privilege of the floor: Florence Alpert wanted to know the status of the Road Use Agreement. She also requested 2 Freedom of Information Law (FOIL) which was given to the Clerk/Foil Officer. Her foil request regards a listing of any parcel of land held by or maintained in trust for the Town of Candor. The other - copies of e-mail correspondence processed via the Board Members relating to meetings with any gas companies regarding negotiating a Road Use Agreement and/or a lease agreement with the Town.
Closing Privilege of the floor: Tammy Lindsay felt that Fred Martinez and Florence Alpert took the floor because of Chris Curkendall walking out of the RUA meeting. She does not like Chris Curkendall working on the RUA. She works for C-Bord and is using her title to influence the Candor people that she is an expert when it comes to this Road Use Agreement. She questions the motive of Fred Martinez and Chris Curkendall being involved with the RUA, she feels it's quite evident that Mr. Martinez is against gas drilling and as a land owner does not appreciate their involvement.
Closing Privilege of the floor: Fred Martinez spoke out about him not being against the gas drilling but only concerned that Candor is not prepared for the heavy road usage from the gas companies.
