Candor Town Board Meeting March 10, 2009
The Candor Town Board met at the Town Hall, 101 Owego Road. Deputy Supv.
Dougherty called the meeting to order at 7:03pm with pledge to the flag and Clm. Cobler
offered prayer.
Present: Deputy Supv. Dougherty, Clm. Bish, Clm. Lindsay and Clm. Cobler. Supv.
Collins was excused from the meeting.
Others present: Code Enforcement Officer James Douglas, Town Clerk Connie Kulze, 7
people from the public and 2 press representatives. Highway Superintendent Kevin
Noble was also excused.
Minutes of the February 24th meeting presented and reviewed.
M-40 Clm. Cobler moved seconded by Clm. Bish to accept the minutes as presented.
Vote - 4 ayes and 0 nays.
Various Reports were presented to the Board and filed with the Clerk.
The Board and Public were informed of the correspondence received since the last
meeting which, included a Special Franchise Assessment, Time Warner Franchise fee
payment, COG letter regarding low turnout at their meetings and encouraging attendance
from Municipalities along with their minutes, Local Gov't efficiency & competitiveness
update, Flood Summit brochure, cable rate increase, residential assessment ratio and a
letter from Couglin & Gerhart pertaining to the Darlington case.
Clm. Lindsay was asked to report on the Highway Complex Property Committee. He
proposed that Joe Bish, Kevin Noble, Jane Maas, Vem Quick Sr., Steve Green, Jeff
Matoon .and himself makeup the Committee. He intends that they will be meeting once a
month.
M-41 Clm. Cobler moved seconded by Clm. Dougherty to appoint these people to be
the Highway Complex Property Committee. Vote - 4 ayes and 0 nays.
United Alarm Systems were notified of the local authorities to be contacted in case of an
emergency.
Clm. Cobler reported that the Planning Board is looking into developing a local
ordinance that will provide for broader control than just road maintenance.
M-42 Clm. Cobler moved and seconded by Clm. Bish to have the Minute Books
microfilmed and a CD made at Challenge Industries in Ithaca. Vote - 4ayes and 0 nays.
The Town Board has decided to withdraw from the initial agreement of purchasing land
from Joyce Aman for a gravel pit located in Catatonk. It was discussed that the Town has
an agreement already in place to remove gravel from the pit located on Spencer Road in
which Joyce Aman also owns.
M-43 Clm. Cobler moved seconded by Clm. Bish to grant Highway Superintendent
permission to draw up an agreement similar to the one on Spencer Road for the removal
of gravel located near the intersection of Catatonk Hill Rd. and NYS Rte. 96 in the Town
of Candor. In which, the Municipality shall pay the Landowner, monthly $1.00 for each
cubic yard of gravel removed from the premises. Vote - 4 ayes and 0 nays.
Clm. Cobler who is Candor's REAP Representative spoke that they would be a
tremendous asset to the Local Municipalities in writing up grants, training and classes,
obtaining a list of local resources available along with technician support. REAP would
like to encourage the Municipalities to take advantage of this wonderful assistance. Clm.
Cobler will be in contact with Mayor Spaulding regarding a Village REAP
Representative to be involved. Clm. Cobler encouraged the Board to fill out the Council
of Governments Survey, which was included in their packets.
C-2 The Village of Candor has requested another letter of endorsement to support
their request of State and Federal assistance to improve the Village's existing water
supply system.
M-44 Clm. Bish moved and seconded by Clm. Lindsay to submit a letter of
endorsement in support of the Village obtaining the grant money, which is in Governor
Paterson's limited stimulus package available to municipalities and school districts. Vote
- 4 ayes and 0 nays.
Deputy Supervisor Milton Dougherty spoke on the Memorandum of Understanding for
Municipal Cooperation in Condemnation Proceedings, which could be executed between
the County of Tioga and its Local Municipalities. The memorandum would provide for
cooperation between the two if a demolition is to be done which could possibly save tax
payer money.
Clm. Lindsay reported talking to Jim Doucett about storing materials excavated from the
gravel pit located on Spencer Rd. He has given the Town permission to store stone and
gravel on his property for $1,000/year as long we maintain the driveway, keep the dust
down and level the area to be used.
M-45 Clm. Bish moved and Clm. Cobler seconded to grant Highway Superintendent
Kevin Noble permission to draw up an agreement with Mr. Jim Doucett regarding renting
his property to store stone and gravel for the Town Highway Department. Vote - 4 ayes
and 0 nays.
Deputy Supervisor Dougherty spoke for Kevin Noble in his absence regarding Advocacy
Day, which, Kevin is participating in. A group of 41 people are 10bWng legislanJ:es in
Albany to restore the CHIPS money. Dougherty also mentioned the New Dump Truck is
not finished yet and that the Bids on the 2001 Ford pickup will close March 24 @ Noon.
Code Enforcement Officer James Douglas submitted his monthly report and gave us an
update of the Court Clerk's Office door. He also brought up appearance tickets being
mailed instead of served by a Constable, which would be more cost effective.
M-46 Clm. Bish moved to adjourn the meeting at 8: l opm and Clm. Cobler seconded it.
Vote 4 ayes and 0 nays.
