Candor Town Board Meeting January 26, 2010

The Candor Town Board met at the Town Hall, 101 Owego Road. Supervisor Cobler called the meeting to order at 7:09pm with pledge to the flag and Clm. Gary Whittemore offered prayer.

Present: Supervisor Darlene Cobler, Clm. Joseph Bish, Clm. Milton Dougherty, Clm. Dan Lindsay and Clm. Gary Whittemore. Others present: Attorney Kurt Schrader, Code Enforcement Officer James Douglas, Highway Superintendent Kevin Noble and Town Clerk Connie Kulze.
Guest: 16 people from the public and 2 Press Representatives.

Privilege of the floor: Fred Martinez thanked the Town Board for going ahead with the Road Use Agreement and offered his assistance in any way.

Supervisor Cobler took a moment to welcome Clm. Joseph Bish back.

Minutes of the January 12th meeting were reviewed by the Board and corrected.
M-18 Clm. Lindsay moved, seconded by Clm. Whittemore to accept the minutes of January 12th as corrected. Vote – Supv. Cobler – aye, Clm. Bish – aye, Clm. Dougherty – aye, Clm. Lindsay – aye and Clm. Whittemore – aye.

C-4 Trident Insurance notified us of a few changes and thanked us for the business.

William Kulze did research on the Clerk’s computer comparing Dell’s site with the State’s web site and found going with a 220 Vostro through Dell would be cheaper.

M-19 Supv. Cobler moved, seconded by Clm. Bish to allow Mr. Kulze to order the Vostro 220 with mini tower in the amount of $870. Vote – Supv. Cobler – aye, Clm. Bish – aye, Clm. Dougherty – aye, Clm. Lindsay – aye and Clm. Whittemore – aye.

Supv. Cobler talked with Jeff Farmer regarding changes to our insurance, quote will be supplied by our next meeting.

Notations to the 2008 and 2009 minutes are completed.

Highway Superintendent Noble has started the Excavator process. Mr. Noble has priced slightly used ones, which he thinks would be the way to go. Going price is around $200,000. Mr. Noble also mentioned some flooding issues on account of our weather, he also stated that Eiklor Road has not been closed as of yet.

Code Enforcement Officer Douglas reported posting a legal ad in the paper requesting proposals for the NYSERDA grant application. The other item Mr. Douglas is working on is resolving the existing leaking roof problem at the Highway Garage. Mr. Douglas will contact a NYSERDA consultant to confirm grant eligibility.

WHEREAS, the Town Board of the Town of Candor, Tioga County, New York wishes to designate the Town Supervisor and/or Highway Superintendent, for the purpose of opening bids at the Town Hall at a time designated by the advertisement for bids printed in the Town’s designated newspaper and,

WHEREAS, General Municipal Law Section 103 requires the Town Board by resolution to designate any officer or employee to open the bids at the time and place specified in the notice and,

NOW THEREFORE, BE IT RESOLVED, for reasons of efficiency and pursuant to the authority conferred by section 103 of the General Municipal Law, it is determined by the Candor Town Board that the Town Supervisor and/or Highway Superintendent are authorized to open bids at the time and place specified in the notice.

BE IT FURTHER RESOLVED, that the Town Supervisor and/or Highway Superintendent shall make a record of such bids in such form and detail as the Board shall prescribe and shall present the same at the next regular or special meeting of the Town of Candor. All bids received shall be publicly opened and read at the time and place so specified.
R-15 Clm. Dougherty moved, seconded by Clm. Bish to adopt above resolution.
Roll Call Vote: Cobler – aye, Bish – aye, Dougherty – aye, Lindsay – aye and Whittemore – aye.

Tioga County R.E.A.P. LDC is requesting financial support from the Town of Candor for 2010. Supv. Cobler mentioned that the County, Town of Barton and the Town of Owego are not supporting the program this year, which is phasing out.

M-20 Clm. Bish moved, seconded by Clm. Lindsay to scrap Assessor’s printer in her office. Vote – Cobler – aye, Bish – aye, Dougherty – aye, Lindsay – aye and Whittemore – aye.

The Board discussed the removal of scrapped items, which is taking up room in our storage area. It was decided that we would pay Taylor $7.50 for each item and Supr. Noble stated he had a few items also to include.

Supervisor Cobler audited the Clerk’s Fee books for 2008, 2009 and found the books to be in good order. The errors and recommendations were minor and easily found and corrected.

M-21 Clm. Bish moved, seconded by Clm. Dougherty to go into Executive Session for Land Discussion at 7:50pm. Vote – Cobler – aye, Bish – aye, Dougherty – aye, Lindsay – aye and Whittemore – aye.

M-22 Clm. Bish moved, seconded by Clm. Lindsay to go out of Executive Session at 8:20pm. Vote – Cobler – aye, Bish – aye, Dougherty – aye, Lindsay – aye and Whittemore – aye.

M-23 Clm. Bish moved, seconded by Clm. Lindsay to adjourn at 8:21pm.
