Candor Town Board Meeting January 12, 2009

The Candor Town Board met at the Town Hall, 101 Owego Road. Supervisor Cobler called the meeting to order at 7:00pm with pledge to the flag and Clm. Milton Dougherty offered prayer.

Present: Supervisor Darlene Cobler, Clm. Milton Dougherty and Clm. Dan Lindsay and Clm. Whittemore and Clm. Joseph Bish was excused.
Others present: Code Enforcement Officer James Douglas, Highway Superintendent Kevin Noble, Town Clerk Connie Kulze and Attorney Kurt Schrader.
Guest: 11 people from the public and 2 Press Representatives

Privilege of the floor: Steve Green took the floor congratulating the newly elected officials. Suggested the Town of Candor have a voluntary State Audit done on the books. Steve Green also stated he would like something done to the intersection of Tubbs Hill Road and Honeypot Road.

The Board reviewed minutes of the December 22nd meeting and was accepted by the Board as read.

The Board reviewed minutes of the January 4th Organizational meeting.
M-3 Clm. Lindsay moved, seconded by Clm. Whittemore to accept the minutes as read.

M-4 Clm. Lindsay moved, seconded by Clm. Whittemore to transfer Banking authority to Supervisor Cobler, Deputy Supervisor Bish and Town Clerk Kulze. Vote - Supv. Cobler – aye, Clm. Dougherty – aye, Clm. Lindsay – aye, Clm. Whittemore – aye and Clm. Bish – absent.

M-5 Supervisor Cobler moved, seconded by Clm. Lindsay to amend 1st meeting of each month for 2008 and 2009 by adding General Claims and Highway Claims information.
Vote – Supv. Cobler – aye, Clm. Dougherty – aye, Clm. Lindsay – aye, Clm. Whittemore – aye and Clm. Bish – absent.

C-1 New York State Department of Environmental Conservation adopted revision to the state's dam safety regulations. Candor is a Class A so these revisions do not affect us.
C-2 Integrys Energy Services of NY tariff changes will become effective on January 1, 2010. The changes will be labeled on our bill as Ancillary services or Unaccounted for energy (UFE).
C-3 Received bill from the Tioga County Self-Insurance Plan for workers' compensation for the year 2010.

Supervisor's report for the month of December 2009, Town Clerk's and Dog Control reports for the month of December 2009 were reviewed by the Board and filed with the Clerk.

M-6 Clm. Lindsay moved, seconded by Clm. Whittemore to authorize Christine Curkendall and Patti Reichert from the Planning Board to attend the Association of Towns Annual Meeting held in New York City. Vote – Supv. Cobler – aye, Clm. Dougherty – aye, Clm. Lindsay – aye, Clm. Whittemore – aye and Clm. Bish – absent.

M-7 Clm. Lindsay moved, seconded by Clm. Whittemore to authorize Supervisor Darlene Cobler and Clm. Milton Dougherty to attend the Association of Towns Annual Meeting held in New York City. Vote – Supv. Cobler – aye, Clm. Dougherty – aye, Clm. Lindsay – aye, Clm. Whittemore – aye and Clm. Bish – absent.

M-8 Clm. Lindsay moved, seconded by Clm. Whittemore to appoint Supervisor Cobler as Delegate and Clm. Dougherty as Alternate at the Association meeting. Vote – Supv. Cobler – aye, Clm. Dougherty – aye, Clm. Lindsay – aye, Clm. Whittemore – aye and Clm. Bish – absent.

M-9 Clm. Lindsay moved, seconded by Clm. Whittemore to authorize payment for transportation to New York City to the Town of Union for bus fare. Vote – Supv. Cobler – aye, Clm. Dougherty – aye, Clm. Lindsay – aye, Clm. Whittemore – aye and Clm. Bish – absent.

M-10 Clm. Lindsay moved, seconded by Clm. Whittemore to authorize per diem to those attending the Annual Meeting to be set at $250. Vote – Supv. Cobler – aye, Clm. Dougherty – aye, Clm. Lindsay – aye, Clm. Whittemore – aye and Clm. Bish – absent.

Workshop on Road Use Agreement will be held at the Town Hall on January 26 at 6:00pm. Supv. Cobler asked Attorney Kurt Schrader and Highway Superintendent Kevin Noble to attend.

M-11 Clm. Lindsay moved, seconded by Clm. Dougherty to authorize Highway Superintendent Noble to piggy back with the Town of Owego for the Snow Sand Bid. Vote – Supv. Cobler – aye, Clm. Dougherty – aye, Clm. Lindsay – aye, Clm. Whittemore – aye and Clm. Bish – absent

Highway Superintendent Noble wanted to publicly commend his highway crew for a job well done on the roads. Superintendent Noble also stated that Eiklor Rd. would be barricaded. At present, the public is illegally plowing the road.

Code Enforcement Officer James Douglas handed in his monthly and annual report, which the Board reviewed and is filed with the Clerk.

Officer Douglas also updated the Board on the NYSERDA Grant. They are hoping for a 20% reduction at the Town Hall and as much as 40% reductions at the Town Barns for the energy cost savings.

M-12 Clm. Lindsay moved, seconded by Supv. Cobler to waive the permit fee for the Cicci's demolition, who lost everything in a fire. Vote – Supv. Cobler – aye, Clm. Dougherty – aye, Clm. Lindsay – aye, Clm. Whittemore – aye and Clm. Bish – absent.

Privilege of the floor: Mr. Baust commented on the Coney's house construction, in which they have had temporary occupancy for the last 3 years. Mr. Baust felt the Board was showing favoritism.

There was much discussion regarding the Coney's progress on their house construction.

M-13 Clm. Lindsay moved, seconded by Clm. Dougherty to extend the temporary permit for their trailer located on the property to July 12th, after that it must be removed. Vote – Supv. Cobler – aye, Clm. Dougherty – aye, Clm. Lindsay – aye, Clm. Whittemore – aye and Clm. Bish – absent.

WHEREAS, it is necessary to appoint Officers to the Planning Board and
WHEREAS, the Board is in agreement with the recommendations made by the Planning Board at their January 5 Meeting and
WHEREAS, those recommendations being

NOW THEREFORE be it
RESOLVED: That the listed Officers be appointed for the year 2010.
R-12 Clm. Lindsay moved, seconded by Clm. Dougherty to adopt the above resolution. Roll Call Vote: Cobler – aye, Bish – absent, Dougherty – aye, Lindsay – aye, Whittemore – aye.

WHEREAS, NYS and Local Retirement System put new regulations into effect on August 2009, and
WHEREAS, it is required Through Regulation 315.4 that each governing board must establish standard work days for elected and appointed officials, and
WHEREAS, these regulations effect the positions of Town Clerk, term to expire 12/31/2011, Highway Superintendent term to Expire 12/31/2011, Assessor, appointed and Code Enforcement Officer, appointed: NOW THEREFORE be it RESOLVED: That the standard work day be established at 8 hours for the above listed Appointed and Elected Positions in the Town of Candor.

M-14 Clm. Dougherty moved, seconded by Clm. Lindsay to reappoint Matt Crowe to the Planning Board which is a 7 year term. Vote – Supv. Cobler – aye, Clm. Dougherty – aye, Clm. Lindsay – aye, Clm. Whittemore – aye and Clm. Bish – absent.

M-15 Clm. Dougherty moved, seconded by Clm. Lindsay to set Constable pay at $30 per incident. Vote – Supv. Cobler – aye, Clm. Dougherty – aye, Clm. Lindsay – aye, Clm. Whittemore – aye and Clm. Bish – absent.

M-16 Clm. Lindsay moved, seconded by Clm. Whittemore to set Dog Enumerator pay at $1.75 per dog. Vote – Supv. Cobler – aye, Clm. Dougherty – aye, Clm. Lindsay – aye, Clm. Whittemore – aye and Clm. Bish – absent.

WHEREAS it is necessary to recommend appointments and
WHEREAS it is the Town Board's desire to renew the Appointment of William Kulze as IT Tech.
NOW THEREFORE be it
RESOLVED: That the listed Appointment be adopted for the year 2010.
R-14 Clm. Dougherty moved, seconded by Clm. Lindsay to adopt the above resolution. Roll Call Vote: Cobler – aye, Bish – absent, Dougherty – aye, Lindsay – aye, Whittemore – aye.

Supv. Cobler spoke with Don Paterson with NYMIR and was informed that they have lowered their rates for insurance. The Board decided to stay with Jeff Farmer this year since it is late and will put it out for bid next fall.

Court Clerk Lynn Craig gave Assessor Denise Spaulding a new printer for her office.

William Kulze received 3 quotes on upgrading the Town Clerk's computer but was not aware of State web site. Will do more research and get back with the Board.

The Board audited General Government Claims #1-20 and #347-352 in the amount of $29,688.63. The Board audited highway Claims #1 and #276-298 in the amount of $89,658.94.
