Candor Town Board Meeting December 8, 2009

The Candor Town Board met at the Town Hall, 101 Owego Road. Supervisor Terry Collins called the meeting to order at 7:00pm with pledge to the flag and Clm. Milton Dougherty offered prayer.

Present: Supervisor Terry Collins, Clm. Joseph Bish, Clm. Darlene Cobler, Clm. Milton Dougherty and Clm. Dan Lindsay Others present: Code Enforcement Officer James Douglas, Highway Superintendent Kevin Noble, Town Clerk Connie Kulze, 5 people from the public and 1 Press Representative.

Privilege of the floor: Christine Curkendall, who is on the Candor Planning Board and The Citizens Advisory Group. She passed out copies of the final draft of the Road Use Agreement and asked permission to forward it to the Town of Owego's Attorney Judy Quigley.

Minutes of the November 24, 2009 meeting were reviewed by the Board and corrected. M-138 Clm. Dougherty moved, seconded by Clm. Cobler to accept the minutes of the November 24th meeting as corrected. Vote 5 ayes and 0 nays.

C-30 New York Rural Water Association (NYRWA) is working with the Village of Candor on a source water protection plan, in which the Association invited the members of the Board to a workshop on December 17 at 7:00pm at the Candor Town Hall, 101 Owego Rd.

Town Clerk's monthly fee report, Dog Control monthly activity report, Code Enforcement monthly activity report were presented to the Board and filed with the Clerk.

M-139 Supervisor Collins moved, seconded by Clm. Bish that Candor agrees with TING's final draft that goes to DEC regarding the Draft Supplemental Generic Environmental Impact Statement (SGEIS). We will be sending the recommendations to DEC. Vote 5 ayes and 0 nays.

M-140 Clm. Bish moved, seconded by Clm. Lindsay to accept Partners in Safety 2010 Drug and Alcohol Testing Agreement for the Candor Highway Department. Vote 5 ayes and 0 nays.

Superintendent Kevin Noble reported receiving four OGS bids on the 10 Wheeler he would like to purchase. #1 – Tracey Road Equipment with 2 figures $179,730 & $177,723, #2 – BURR Truck & Trailer Sales, Inc. - $181,535.86 and #3 Stadium International Trucks - $ 184,366.30. Superintendent Noble recommended going with BURR. Low bid was not taken because of poorly engineered plow and plow gear.
M-141 Clm. Cobler moved, seconded by Clm. Lindsay to accept BURR's quote for $181,535.86. Vote – 5 ayes and 0 nays.

M-142 Clm. Bish moved, seconded by Clm. Cobler to declare the Flink Sander as surplus. Vote – 5 ayes and 0 nays. M-143 Clm. Dougherty moved, seconded by Clm. Cobler for the Candor Highway Department to assist Candor Central School in emergency situations with salt & sand for their parking lot and road. Vote – 5 ayes and 0 nays.

M-144 Clm. Bish moved, seconded by Clm. Lindsay to sell the excavator to the Town of Richford for the amount of $30,000. Vote – 5 ayes and 0 nays.

Supervisor Collins thanked Code Enforcement Officer James Douglas for the work on the doors at the Highway Department.

Code Enforcement Officer Douglas wanted to publicly thank Judge Dence for his cooperation enforcing our Local Junk Law.

Code Enforcement Officer Douglas stated he filled out a credit application with (bulbs.com) for ordering replacement light bulbs. He spoke of the significant savings and ordered 10 bulbs today.

Supervisor Collins stated that Don Paterson from Partners Insurance contacted him regarding insurance for 2010 who stated he would like to give a presentation to the Town Board for NYMIR's proposal.

M-145 Supervisor Collins moved, seconded by Clm. Lindsay to go into Executive Session at 8:17 regarding purchase of property. Supervisor Collins asked Councilman elect Gary Whittemore and Bernie Smith to sit in on the meeting. Vote 5 ayes and 0 nays.

M-146 Supervisor Collins moved, seconded by Clm. Dougherty to go out of Executive Session at 8:42. Vote 5 ayes and 0 nays.

M-147 Supervisor Collins moved, seconded by Clm. Lindsay to pursue purchase of Smith/Pipher property located at 105 Owego Road for $32,000. Vote – 5 ayes and 0 nays.

M-148 Clm. Bish moved, seconded by Clm. Lindsay to adjourn at 8:50pm.
