Candor Town Board Meeting November 9, 2010

The Candor Town Board met at the Town Hall, 101 Owego Road. Supervisor Darlene Cobler called the meeting to order at 7:00pm with pledge to the flag followed by Clm. Milton Dougherty offering a prayer.

Present: Supervisor Darlene Cobler, Clm. Joseph Bish, Clm. Milton Dougherty, Clm. Dan Lindsay and Clm. George Williams.
Others present: Highway Superintendent Kevin Noble, Code Enforcement Officer James Douglas and Town Clerk Connie Kulze.
Guest: 3 people from the public and 1 Press Representative

Supervisor Cobler opened the Public Hearing on the Preliminary Budget at 7:05pm as advertised. Supv. Cobler spoke to the public in regards to changes that have taken place from 2010 to 2011 budget as it pertains to the tax rate, increase in retirement from the State and sales tax revenues which are down. One item that the Board did add under Assessor was money to start the full revalve which will ultimately raise taxes, but the Board felt it was justified.

R-22 Supv. Cobler moved, seconded by Clm. Bish to adopt the Preliminary Budget and establish as the Annual Budget for 2011. Roll Call Vote: Cobler-aye, Bish-aye, Dougherty-aye, Lindsay-aye and Williams-aye.

Whereas: the Candor Town Board duly held a Public Hearing on the Preliminary Budget for the fiscal year 2011, and having heard all persons desiring to be heard on the budget, and the budget been fully discussed and considered, it is Resolved: the said Preliminary Budget is hereby adopted and established as the Annual Budget, and as so is included in the minutes of the proceedings of the Town Board.

M-136 Clm. Dougherty moved, seconded by Clm. Williams to accept the minutes of the October 26, 2010 meeting as corrected. Vote: Cobler-aye, Bish-aye, Dougherty-aye, Lindsay-aye and Williams-aye.

M-137 Clm. Dougherty moved, seconded by Clm. Williams to accept the minutes of the November 2, 2010 meeting as corrected. Vote: Cobler-aye, Bish-aye, Dougherty-aye, Lindsay-aye and Williams-aye.

November 17 at 1:30-3:00 Cornell will be hosting a Marcellus Shale Webinar on "Monitoring for Water Resource Impacts: Risks and Science".

Town Clerk’s monthly report, Dog Control monthly report and Supervisor’s monthly report was presented to the Board and is filed with the Clerk.

Supv. Cobler received Rule XIV on Probationary Terms which she will copy for Supt. Noble for him to have on file.

  Town of Candor 2010 Policy on Health Insurance

Health insurance will be provided to all fulltime employees with the cost being borne as negotiated in each year’s contract. Fulltime is defined as working a minimum of 30 hours per week for the Town.

Part-time employees will be eligible to purchase coverage with the employee bearing the full cost of the premium.

All employees will contribute toward their health insurance at the same rate as negotiated with the Highway Employees.

All employees shall be eligible for membership in the BC/BS prescription Plan which shall require the employee to pay $5 per prescription for generic prescriptions, $15 for name brand prescriptions and $30 for name brand prescriptions that are new to the market.

Employees shall be eligible for Prime Blue Dental Classes I & II.

Health Insurance will be provided to the Highway Superintendent and Town Clerk providing he/she works a minimum of 30 hours a week.

All non-contractual employees who have health insurance will have deductions taken out of their bi-weekly pay checks.

Health insurance coverage will be provided to those who retire while employed by the Town and have a minimum of 10 years of uninterrupted full time service at the time of retirement. An employee who opts for the insurance buyout will be eligible for health insurance through the Town when he/she becomes eligible to retire even if he/she does not have Town health insurance at that time.

All employees retiring on or after January 1, 2004, and are eligible for health insurance upon retiring, will contribute to the Town for health insurance commensurate with rates of current employees.

Upon the death of an employee or retiree the spouse will have the option of continuing their health insurance with the full cost to be borne by the spouse.

As long as Shirley Mayer is Bookkeeper for Town of Candor, the Town will pay for dental insurance up to $150 a year. When she leaves employment of the Town of Candor, she will have the option to pay for her own dental.

Any employee eligible for family health insurance coverage, upon proof of coverage through their spouse’s employer, and who opts to decline coverage through the Town, will be compensated by the Town at a rate of $3,000 annually to be paid bi-weekly.

Effective 11/9/10 the Town will no longer make reimbursement for the Medicare Part B premium. Note: as of 11/1/2010 Ann Lounsbury and Lionel Fields are grandfathered at the 100% rate.

This agreement supersedes all previous language related to health insurance.

 

M-138 Clm. Bish moved, seconded by Clm. Lindsay to adopt the Town of Candor 2010 Policy on Health Insurance. Roll Call Vote: Cobler-aye, Bish-aye, Dougherty-aye, Lindsay-aye and Williams-aye.

The Board decided that 2 people from the Planning Board and 2 from the Town Board would be able to attend the New York Association of Town’s meeting in New York City which will be held in February of 2011.

There will be a Village Dissolution Meeting on December 6, 2010 at 7:00pm being held at the Candor Fire Hall. Superintendent Noble informed the Board of the progress with the Teitsworth Auction.

M-139 Clm. Bish moved, seconded by Clm. Lindsay to allow Kevin Noble to eliminate the reserve on the Excavator being auctioned by Teitsworth. Vote: Cobler-aye, Bish-aye, Dougherty-aye, Lindsay-aye and Williams-aye.

M-140 Clm. Bish moved, seconded by Clm. Lindsay to permit Superintendent Noble to accept the County bid for aggregate processing. Vote: Cobler-aye, Bish-aye, Dougherty-aye, Lindsay-aye and Williams-aye.

Superintendent Noble stated the Catatonk Bridge work is on hold until the spring of 2011.

Code Enforcement Officer’s monthly report was presented to the Board and is filed with the Clerk.

Code Enforcement Officer Douglas reported that the solar panels, controls and storage tanks are installed at the Town Hall through the NYSERDA Grant. Code Enforcement Officer Douglas stated filing a violation on the Coney’s and also stated that they failed to appear in court.

Assessor Spaulding wants the Town Board to pass a resolution to change the deadline date of the Senior Citizen Exemption Application age date to December 31 to match the enhanced Star Exemption.

General Government Claims #256-282 in the amount of $22,184.44 were audited by the Board. Highway Claims #249-265 in the amount of $189,495.38 were audited by the Board.

Closing Privilege: Mr. Roger Jantz took the floor asking questions regarding how the Village is taxed and how it differs from the Town.

M-141 Clm. Williams moved and was seconded by Clm. Lindsay to go into Executive Session regarding the Assessor’s agreement at 8:08pm . Vote: Coble-aye, Bish-aye, Dougherty-aye, Lindsay-aye and Williams-aye.

M-142 Clm. Bish moved, seconded by Clm. Lindsay to come out of Executive Session at 9:30pm.

 

Town of Candor Assessor Agreement

Term of Agreement: The term of this Agreement shall run concurrent with the term of appointment of the Town of Candor Assessor.

Assessor Committee: The Candor Assessor Committee is appointed by the Candor Town Supervisor at the Organizational Meeting in January of each calendar year.

The duties and benefits of the person who is appointed to fill the office of Town of Candor Assessor shall be as follows:

Duties:

  1. 1) The Candor Assessor shall perform all of the duties and responsibilities required of an Assessor by law.

  2. 2) The Candor Assessor or the Assessor Committee may request a committee meeting as often as deemed necessary.

  3. 3) The Assessor shall prepare a monthly report for the Town Board to be presented at the first Town Board meeting (the second Tuesday) of each month for the prior month to include the following:

    1. a. An overview of the activities of the previous month

    2. b. Schooling I training taken

    3. c. Assessor hours worked

    4. d. Mileage for Assessor responsibilities

    5. e. Leave time taken

    6. f. Other information of which the Town Board should be aware

  4. 4) The Town requires a log to be maintained of in and out of office hours. Out of office hours to include but not limited to site of activities, work performed, time spent and mileage for personal and/or town vehicle.

  5. 5) Attendance will be required at the Board Meetings the Fourth Tuesday of each month.

  6. 6) The number of hours the Assessor works shall be a minimum of 16 and a maximum of 29 per week. The Assessor will work in the Town of Candor a minimum of Tuesday and Thursday between the hours of 8 am and 4 pm. On the fourth Tuesday of the month the Assessor will work from noon until 7:00 pm at which time she/he will attend the Town Board Meeting. The Assessor will be in the office on Thursdays between the hours of 9:00 am and 1:00 pm and the fourth Tuesday of the month from 5:00 pm to 7:00 pm. Additional hours will be worked as required by State Law to cover such items as Grievance Day, public viewing of tentative rolls, etc. There will be no comp time for additional time worked.

  7. 7) The Assessor must keep the Board informed through the Town Supervisor if he/she will not be in the Office.

  8. 8) The Assessor shall bring all matters that require a Town Board decision to the Assessor Committee. The Committee will then present the matter to the Board with a recommendation, including but not limited to attendance at schooling and meetings.

Salary: The Assessor's wage shall be determined by the Town Board at the Organizational Meeting in January of each calendar year. Factors used to establish the rate will include but are not limited to length of service, increase or decrease in work load, and job performance in general.

Health Insurance: As a part-time employee the Assessor has the right to participate in the Town’s health insurance plan at his/her expense.

Worker’s Compensation: The Assessor is covered under the Town’s Worker’s Compensation Program.

Leave Time: The Assessor will earn the following leave with pay upon satisfactory completion of the above duties and requirements. All leave time will have preauthorization from the Town Supervisor in writing. Failure to receive preauthorization will result in loss of pay on a perdiem basis.

Upon first appointment   3 days
After five years   6 days
After seven years   8 days
After twelve years   10 days

No days will carry to the next calendar year. There will be no paid holidays without applying a leave day to cover the time.

Training/Schooling: The Assessor will at all times keep his/her credentials current with the State’s requirements.

Driver’s License: The Assessor will at all times possess a driver’s license that is valid in New York State.

M-143 Clm. Bish moved, seconded by Clm. Lindsay to have Supervisor Cobler present Assessor Spaulding with the final agreement for signatures. Vote: Cobler-aye, Bish-aye, Dougherty-aye, Lindsay-aye and Williams-aye.

M-144 Clm. Bish moved, seconded by Clm. Lindsay to cancel the November 30th meeting. Vote: Cobler-aye, Bish-aye, Dougherty-aye, Lindsay-aye and Williams-aye.

Attorney Schrader presented the new Dog Law which he has developed and time was spent in going over it. A public hearing will be set for the 1st meeting in December to present the law.
