Candor Town Board Meeting November 24, 2009
The Candor Town Board met at the Town Hall, 101 Owego Road. Supervisor Terry Collins called the meeting to order at7:03pm with pledge to the flag and Clm. Milton Dougherty offered prayer.
Present: Supervisor Terry Collins, Clm. Joseph Bish, Clm. Darlene Cobler, Clm. Milton Dougherty and Clm. Dan Lindsay
Others present: Code Enforcement Officer James Douglas, Highway Superintendent Kevin Noble, Town Clerk Connie Kulze, 8 people from the public and 1 Press Representative.
Privilege of the floor: Gary Henry, Chairman of the Candor Planning Board gave an update on their meetings over the past 3 months. People are concerned about the gas drilling and protecting water, environment and roads. Planning Board would like to get some zoning in order to have an industrial area. DEC is more or less in control and has final decision even over Home Rule. He also stated that the Public Service Commission regulates where the pipelines go. Planning Board has formed the Citizen Advisory Group Committee, which attends the meetings regarding the gas drilling so they can better inform the Board. Gary also mentioned about putting a survey out to get comments and ideas from the public. Another concern was noise ordinance and Industrial driveway permits.
Supervisor Collins told Gary Henry that any decision concerning drilling will be made by DEC and the legislators, we really don’t have much say in the matter. Also stated it was very hard to enforce the noise ordinance.
Minutes of the November 10th meeting were reviewed and corrected by the Board.
M-133 Supv. Collins moved and Clm. Dougherty seconded to accept the minutes as corrected. Vote – 5 ayes and 0 nays.
C-28 The Candor Fire District turned their 2010 Budget in. Supv. Collins stated that last year it was $366,000 and this year it went up to $414,489.14. Town Board has no say in it as to accept it or not, Candor people vote on Fire District Budget and once it’s passed it gets turned in with the Town’s Budget to the County.

Supervisor Collins spoke about the Town Reassessment and speaking with Donn Weber from NYS Real Property Office. Mr. Weber can help out with setting up the computer for Assessor Spaulding. It was decided that we would like Mr. Weber to attend a meeting in December to talk once again on the process of reassessing.
Supervisor Collins spoke with Town of Tioga Supervisor Lewis Zorn about the CAP (Coordinated Assessment Program) we have with them regarding sharing Assessor Spaulding and splitting her health care insurance. Mr. Zorn stated they would like to get out of it with retaining Health Insurance for Assessor Spaulding and also the retired assessor with Town of Tioga paying 44% and Candor paying 56%.
Supervisor Collins will look into the legal procedure to get out of the CAP whether it should be a Motion or a Resolution. Also will talk to Assessor Spaulding regarding her agreement regarding the days and hours here at Candor.
Highway Superintendent Kevin Noble handed out the Road Preservation Law in which The Citizens Advisory Group found major loopholes in it. This is the first draft for the vertical drilling, it was suggested highly that we go with a litigation contract.
Supr. Noble asked permission to exchange cobble rock for sand at the last meeting. Ralph Porter and Lopkes declined because DEC will not permit foreign objects in pit. Supr. Noble asked the Board to approve the County Bid to crush cobble.
M-134 Clm. Bish moved and Clm. Lindsay seconded to accept County Bid for Aggregate Processing (crushing cobble rocks). Vote 5 ayes and 0 nays.
Superintendent Noble mentioned the 10 Wheeler that is budgeted for the coming year and would like permission to start getting quotes. New emissions law coming out in mid February, which will increase the price by $10,000. It was decided that Supr. Noble would bring the different quotes to our next meeting.
Superintendent Noble thanked James Douglas for putting the Highway door in. Also received a complaint regarding no yellow lines on Honeypot Road and Candor Hill Road. With fresh stone it isn’t feasible to do this now, it was suggested to put up a few reflectors on the guardrails.
Catatonk Hill guardrails were flattened, about 150 feet worth. No police report submitted.
Permits for the Historical Signs are in and Supr. Noble will notify Historian Carol Henry and the Press for write-ups and photos when the procedure begins.
Code Enforcement Officer James Douglas reported attending the Flood Map Program meeting with Clm. Cobler, which was held in Spencer. They are waiting for DEC to approve it. Also mentioned when he came in the Town Hall on Monday the boiler had shut down, he gave Sure Temp a call and they came out for inspection.
Supervisor Collins received a quote for having the carpets cleaned and it was decided that spring was a better time to do it. At that time we will get 2 or 3 quotes.
Clm. Cobler attended the Municipal Gas Coalition Meeting on November 16th we are to contact Dale Weston if we are interested in participating. Supervisor Collins will notify Mr. Weston.
December 2, 2009 there will be a TING meeting at 7:00pm at the Soil & Water Conservation Dept. anyone interested should contact Elaine Jardine with the County.
December 3, 2009 Chris (Garner) will be presenting an overview of the Marcellus (What it means to Tioga County) at the Hubbard Auditorium at 7:00pm.
M-135 Supervisor Collins moved and Clm. Cobler seconded to go into Executive Meeting at 8:20pm regarding property purchase. Supervisor Collins asked Councilman elect Gary Whittemore to sit in on the meeting. Vote 5 ayes and 0 nays.
M-136 Clm. Lindsay moved and was seconded by Clm. Bish to go out of Executive Meeting at 8:49pm. Vote 5 ayes and 0 nays.
M-137 Clm. Bish moved and Clm. Lindsay seconded to adjourn at 8:50pm.
