Candor Town Board Meeting October 27, 2009

The Candor Town Board met at the Town Hall, 101 Owego Road. Supervisor Terry Collins called the meeting to order at 7:00pm with pledge to the United States Flag and Councilman Darlene Cobler offered prayer.

Present: Supervisor Terry Collins, Clm. Joseph Bish, Clm. Darlene Cobler, Clm. Dan Lindsay and Clm. Milton Dougherty arriving at 7:14pm.
Others present: Highway Superintendent Kevin Noble, Code Enforcement Officer James Douglas and Town Clerk Connie Kulze, Ten people from the public and One Press Representative.

Privilege of the floor: Mayor Steve Sparling spoke of his appreciation to the Town Board for giving the Highway Department permission to assist the Village in paving Foundry Street, Railroad Avenue and sealing McCarty Street. Mayor Sparling presented written Thank You letters to Supervisor Collins and Superintendent Noble.

Minutes of the October 13th meeting were reviewed by the Board and accepted.
M-117 Clm. Cobler moved and Clm. Lindsay seconded to accept the minutes as presented. Vote 4 ayes, 1 absent and 0 Nays.

C-23 Supervisor Collins read the letter received by Mayor Sparling regarding the cooperation of the Town's Highway Department in assisting the Village with street projects.

C-24 A letter from Raymond Maratea's lawyer thanking Clm. Bish, Clm. Cobler, Superintendent Noble and Attorney Weber for meeting at Maratea's residence in helping to facilitate a resolution to the various problems that they have been experiencing.

Supervisor Collins stated a few minor changes have been made to the Preliminary Budget. Judge Dence does not wish to accept his raise of $270, which was added to the Legislative Board C.E.
M-118 Clm. Dougherty moved seconded by Clm. Cobler to adopt the Supervisor's Tentative Budget for 2010. Vote 5 ayes and 0 nays.

Donn Weber from Real Property has contacted Supervisor Collins regarding our decision on Town reassessment. It was decided that we should look into the matter more and see what kind of help the State could give us. Supervisor Collins will contact Donn Weber regarding State help and Clm. Dougherty and Clm. Cobler will be in contact with the Town of Tioga regarding the CAP with them.

Highway Superintendent Noble provided the Town Board with a list of the Seasonal Roads. It was determined that a Motion was made on September 26th, 2000 to open a portion of Eiklor Road beginning December 1st, 2001. Superintendent Noble will revise the Seasonal Road List.
Superintendent Noble asked the Board for permission to use a portion of the $6,700 from the sale of the Patch Truck to purchase a Sander. Superintendent Noble received three quotes on Sanders.
M-119 Clm. Cobler moved Clm. Bish seconded to allow Superintendent Noble to purchase the Sander from Bradco Supply Company for $5750. Vote 5 ayes and 0 nays.

Superintendent Noble was visited by the NYS Labor Department in which, they discovered we did not have a policy written up regarding workplace violence prevention. Superintendent Noble stated he will have one written up and will present it to the Board during the next meeting. We were also given thirty days to have an exit door installed in the truck bay. Code Enforcement Officer Douglas will be putting a doorway in the truck bay for fire purposes.

Superintendent Noble gave an update on Truck 79 and stated that Jim Brixey and Scott Potter are doing a fine job on reconstructing the box.

Superintendent Noble reported reviewing different Road Usage Laws for drilling rigs and stated he is impressed with the contract that Denton County in Texas wrote up. He left the Board with the fourth version that Broome County wrote up.

Code Enforcement Officer Douglas was informed that NYSDEC and FEMA are cooperating on a program to update the Flood Insurance Rate Maps. They have scheduled 3 Community Coordination Meetings for the community officials in Tioga County and Officer Douglas stated he would be attending the one held in Spencer on November 19th.

Brown's River Binding contacted Clerk Kulze regarding preserving another Town Book. Clerk Kulze will be looking over the books to decide which one needs to be done this year.

M-120 Supervisor Collins moved and was seconded by Clm. Cobler at 8:17 to go into Executive Session regarding land acquisition and personnel issues.

M-121 Clm. Dougherty moved and was seconded by Clm. Bish to go out of Executive Meeting at 9:14.

M-122 Motion by Clm. Bish seconded by Clm. Lindsay to adjourn at 9:15.
