PARKING PROHIBITION LAW
TOWN OF CANDOR LOCAL LAW No. 5 of 1990
PARKING PROHIBITION
PURPOSE:
It is the purpose of this Local Law to insure that no vehicles
will be parked along the side of Town highways which parking has in
the past, and if continued, would in the future inhibit the orderly
removal of snow from the driving lanes of the Town highways.
SECTION 1.
The parking of motor vehicles is hereby prohibited on all Town
streets and highways between the hours of 2:00A.M. and 7:00A.M. from
November 15th of each year to and including March 15th of the
following year.
SECTION 2.
Any violation of this Local Law shall be punishable by a fine
not to exceed Fifty ($50.00) Dollars and each additional day upon
which any such vehicle remains parked during the prohibited times and
dates shall constitute a separate offence punishable by a separate
fine of Fifty ($50.00) Dollars for each violation.
SECTION 3.
Any vehicle parked or abandoned on any highway within the Town
in violation of this Local law or during a snowstorm, flood, fire or
other public emergency or which is found unattended in such a location
that it constitutes an obstruction to traffic, may be removed by order
and under the direction of the Superintendent of Highways or any other
officer or agent of the Town of Candor.
SECTION 4.
After removal of any such vehiule as provided in Section 3 above,
such vehicle shall be stored in a suitable place and at the expense of
the owner. The owner or such person in charge of the vehicle may ..
redeem the same upon payment to the town of the amount of all expenses
actually and necessarily incurred in affecting the removal. Such
removal charge is not to exceed the sum of Seventy-Five ($75.00) Dollars,
together with any charges for storage, which charges shall not exceed
the sum of Five ($5.00) Dollars per day or any fractional part of any
day. The date of removal and the date of release or delivery of such
vehicle shall each be regarded as a separate day in computing storage
costs.
SECTION 5.
It shall be the duty of the Town or its designated officer,
employee or agent to ascertain the name of the owner of such vehicle
or person having lawful pOssession of such vehicle, and to notify
such person of the removal and disposition of the vehicle and the
amount which will be required to redeem the vehicle.
SECTION 6.
This Local Law shall become effective November 1, 1990.
