Candor Planning Board Meeting April 7, 2009

  1. I. Called to order – 7:04 p.m.

    • Pledge of Allegiance to the Flag was said.

    • In attendance:

      1. a) Members: Chairman Gary Henry, Jr., Vice-Chairman Art Cacciola, Bob Zebracki, Patti Reichert, Chris Curkendall, Peter Ward, and Matt Crowe.

      2. b) Others: Clerk Angela Smith

      3. c) Guests: Wayne & Darlene Cobler, Jim Douglas, Dan Lindsay, John Madan, Jeremy Toft, Gary & Shirley Hollenbeck, Christina Gordonair, and Terry Collins

  2. II. Privilege of the Floor

    • Terry Collins welcomed our two new members. The Town Board understands that the Road Law has been taken out of the Counties hands and given to the attorneys. The Town Board continues to have problems. Without something in writing to take them to court, we are losing money in upkeep of the roads. The Town is trying to get money from the companies involved, but currently having no luck. Matt Crowe spoke to someone from Ithaca that stated it would come down to weight limits.

    • March 2009 Minutes – Peter Ward motioned to accept the minutes with amendments, Matt Crowe seconded, approved. Ayes (7) Nays (0) Abstentions (0)

    • Town Board Minutes – February 24th and March 10th

    • Updated Planning Board Member Directory

    • Tioga County Officials Flood Summit – anyone interested in attending on April 22, 2009

    • Pipelines in your community

  6. VI. New Business

    • Sketch Plan Conference for Gary Hollenbeck

      • Would like to add another service of NYS Inspection

      • Computerized equipment

      • Certification

      • Not a repair shop, but State calls it a garage

      • Building already exists, isn’t anything new

      • Believe that if it butts the State Highway, it has to go to County, Chairman Gary Henry will check into that.

      • Timetable is based on NYS

      • Change of Occupancy Code due to manufacturing versus garage.

    • Change of Occupancy for John Madan

      • Converting into 3 apartments instead of mercantile. There will be two 1 bedroom apartments and one 3 bedroom apartments.

      • Upper class kind of space with dishwashers, etc.

      • Lighting will remain the same

      • Parking will be the same

      • Interior structural walls

      • Has to go through the motions of going thru the County even if they don’t need to see it.

      • Septic should be okay because it was designed for a restaurant

    • SEQR for Jim Douglas

      • SEQR not needed as it is a Type 2 action which doesn’t require one. However, it does require a Site Plan Review.

      • More discussion for those that weren’t at the last meeting

      • Concerned that there isn’t any plan that shows the kilns. Chairman Gary Henry and Jim Douglas worked out these details and put them on the map.

      • There will be no employees, just Jim himself

      • Peter motioned to approve the Site Plan Review, Patti Reichert seconded. Voting was a unanimous in a roll call of votes. Chairman Gary Henry (aye), Vice Chairman Art Cacciola (aye), Matt Crowe (aye), Peter Ward (aye), Christine Curkendall (aye), Patti Reichert (aye), and Bob Zebracki (aye).

    • Sketch Plan Conference for Jeremy Toft

      • Would like to purchase property at 9 Depot Road and open a small garage

      • Property is in the Flood Plan (insurance)

      • No facilities

      • 4-5 vehicles at a time. Prefers not to deal with junk cars, wants to get them in and out

      • Privacy fence could be put up, but no plans at this time

      • Signage – would like to put up some so that people can find him

      • Will need to capture and store waste oil and anti-freeze

      • Just he and possibly Christina Gordonair for office work. Possibly one other employee in the future depending on business.

  7. VII. Old Business

    • Flood Prevention Law – Chairman Gary Henry will e-mail everyone with the changes that were made so that everyone can review and provide feedback

    • Road Preservation Law – some discussion of whether we should move forward with our own law or wait for the County. Terry Collins feels it will take too long. If we look at Broome County and revamp it for us, please do. Most information is gearing back to weight limits and roads needing to be posted.

    • Peter Ward motioned to adjourn the meeting @ 9:03 p.m., Bob Zebracki seconded, approved. Ayes (7) Nays (0) Abstentions (0).
