Candor Planning Board Meeting January 5, 2010
- I. Called to order – 7:10 p.m.
- Pledge of Allegiance to the Flag was said.
- In attendance:
- a)Members: Vice-Chairman Art Cacciola, Peter Ward, Chris Curkendall, and Matt Crowe. Excused: Chairman Gary Henry, Jr. and Patti Reichert. Absent: Bob Zebracki
- b)Others: Clerk Angela Smith
- c)Guests: Wayne & Darlene Cobler
- II. Privilege of the Floor
- Darlene Cobler – talked about the organizational meeting the previous night and stated that she had a budget for us. Also adopted at the meeting were changes to purchases (see handout), salaries approved at $1,000 per Planning Board Member and $1,800 for Chairman of the Planning Board, Deputy Town Supervisor is Joe Bish, Planning Board Committee is Gary Whittemore and Joe Bish, Mileage requirements (see handout), New Town Attorney Kurt Schrader, and there will be Privilege of the Floor at the beginning and at the end of Town Board Meetings
- III. Review and Modify Agenda
- Matt Crowe motioned to approve the agenda as amended, Peter Ward seconded, approved. Ayes (4) Nays (0) Abstentions (0)
- IV. Review Minutes of the Previous Meeting
- December Minutes – Matt Crowe motioned to accept the minutes as amended, Peter Ward seconded, approved. Ayes (4) Nays (0) Abstentions (0)

- VI. New Business
- Review By-Laws – corrections requested. Peter Ward moved to accept as corrected, Chris Curkedall seconded, approved. Ayes (4) Nays (0) Abstentions (0)
- Election of Officers
- Matt Crowe nominated Art Cacciola and Gary Henry, Jr as Chairman, Chris Curkedall seconded. Written votes were obtained. Art Cacciola received 4 votes and Gary Henry, Jr. received 0 votes.
- Art Cacciola nominated Gary Henry, Jr. as Vice-Chairman. Matt Crowe motioned to close the nominations, Chris Curkendall seconded. Matt Crowe cast 1 ballot for Gary Henry, Jr. as Vice-Chairman, approved. Ayes (4) Nays (0) Abstentions (0).
- Chris Curkendall nominated Matt Crow as Secretary. Chris Curkendall motioned to close the nominations, Art Cacciola seconded. Art Cacciola motioned to cast one ballot for Matt Crowe as Secretary, Chris Curkendall seconded, approved. Ayes (4) Nays (0) Abstentions (0).
- Book of Laws – Chris Curkendall will put together a hard copy of all the laws and give to Angie to copy and put together for everyone else.
- VII. Old Business
- Uniform Fire Prevention – tabled
- Road Use Agreement – took what Owego was working on and tightened it up. After reviewing documents from Kevin Noble and Darlene Cobler and talking with the Citizens Advisory Group, feel that an Escrow account is the way to go. We were once told that it was not doable, but found that you can if not specific to one company, it has to be general. We would define the triggers and order of release. Reporting to the Board what the Citizens Advisory Group has been discussing and changes they have made. Chris Curkendall will also be meeting with the new attorney. Several discussions took place. The Village is also interested in the agreement. Need to definitely seek legal counsel. At the January 25th Planning Board Workshop we should invite Kurt Schrader and two Board members to go over the draft agreement. Chris Curkendall will wait to hear from Darlene if this is possible.
- Town Survey of Critical Areas – would ask the Citizens Advisory Group to identify critical areas so we know they could be an issue. Each area will be listed in a database. Survey will be online, as well as hard copies available at the bank, Town Hall, etc. Chris Curkendall motioned to approve the survey and authorize the Citizens Advisory Group to do it, not seconded, motion died. Need further review and consideration. If it is a critical area it would result in a more extensive environmental review.

- Peter Ward motioned to adjourn the meeting @ 9:05 p.m., Matt Crowe seconded, approved. Ayes (4) Nays (0) Abstentions (0).
