Candor Planning Board Meeting October 6, 2009
- I. Called to order – 7:10 p.m.
- Pledge of Allegiance to the Flag was said.
- In attendance:
- a) Members: Chairman Gary Henry, Jr., Vice-Chairman Art Cacciola, Bob Zebracki, Patti Reichert, Chris Curkendall, Peter Ward, and Matt Crowe
- b) Others: Clerk Angela Smith
- c) Guests: Terry Collins, Jim Douglas, Wayne & Darlene Cobler, Dan Lindsay, Fred & Barbara Liske
- II. Privilege of the Floor
- Terry Collins talked about Road Preservation Law. The Town Board would still like to coordinate with other Towns and they are still working with attorneys. Waiting to see if the County comes up with something. We can present something, but it probably won’t get approved. Trying to make sure it’s done to the best of everyone’s ability. Left up to all the Town and County attorneys.
- Cass Hill and Shoemaker has already been fixed by us. Terry Collins continues to try and contact the company but gets nowhere.
- Talked about setting up something that has a weight limit with an agriculture exemption for tractors, logging and milk trucks, etc.
- DEC is being asked to extend the Public comment period because document in 500-800 pages thick and can only be obtained on-line.
- Matt Crowe asked about Logan Hill Road and Water Street. Terry Collins stated that it has not been settled, they are waiting for the judge. The Town Board can still appeal regardless of how long it takes for the judge.
- Matt Crowe asked Darlene Cobler about Road Preservation Law and driveway. There is not always a permit issued if there is an existing driveway.
- III. Review and Modify Agenda
- Matt Crowe motioned to approve the agenda, Patti Reichert seconded, approved. Ayes (7) Nays (0) Abstentions (0)
- IV. Review Minutes of the Previous Meeting
- September Minutes – Peter Ward motioned to accept the minutes, Matt Crowe seconded, approved. Ayes (7) Nays (0) Abstentions (0)
- V. Correspondence
- Zoning Bulletins – Aug 10th & Sep 10th
- Town Board Minutes – Sep 8th
- VI. New Business
- Liske Variance – Removal of old home and input of a manufactured home. Lot is not normal lot size for mobile home requirements and didn’t conform to mobile home width. Not 100ft of road footage. Big improvement over what is currently there. Would be a slab. Lot is an acre and a half. If stick built, we wouldn’t have any issues. Matt Crowe motioned to accept, Peter Ward seconded, approved by a roll call of votes – Matt Crowe – aye; Peter Ward – aye; Chris Curkendall – aye, Chairman Gary Henry, Jr. – aye; Vice-Chairman Art Cacciola – aye; Patti Reichert – aye; and Bob Zebracki – aye.
- Babcock Variance – Structure burned in 1991, lot size hasn’t changed since. Putting in new septic and well. Vice-Chairman Art Cacciola motioned to accept, Peter Ward seconded, approved by a roll call of votes - Matt Crowe – aye; Peter Ward – aye; Chris Curkendall – aye, Chairman Gary Henry, Jr. – aye; Vice-Chairman Art Cacciola – aye; Patti Reichert – aye; and Bob Zebracki – aye.
- SEQR – asked if 2004 was latest and greatest version. Peter Ward believes it is. Chairman Gary Henry, Jr. handed out the few that we found in the file cabinet.
- VII. Old Business
- Fire Prevention – have the old one(s) been replaced with the new one (the States), or is it still in place. Jim Douglas has been using both. Town Board adopted the new one, but ours has all the setbacks in it. Jim Douglas requests going through the new one and enhancing it. Believe it was just adopted and not replaced or in addition, per say. Jim Douglas will provide us with a copy of the new State law; he has a lot of notes that he has to help us do the new one if we would like them.
- Road Preservation – feel we would be wasting our time to put something together. Escrow and Bonding – Elaine at the County meeting stated this was illegal. Every time Vice-Chairman Art Cacciola calls different people, he gets a different answer. Everybody is concerned about the whole issue. It would take a couple of months to get something passed. By then, it would be the New Year which is when we understand permits will start to be issued. Town Board strongly feels that ours should match all the other Towns. Broome County did something and it was thrown out. Can we post weight limits on the Town Roads? Darlene Cobler stated that Kevin Noble can put signs up. Police told Vice-Chairman Art Cacciola that if Towns came to them, they would enforce them. Darlene Cobler and Terry Collins wanted to know how they would enforce the signs when they are cutting their staff and they don’t have their scales up to date or a way to transport their scales. Kevin Noble has the power to actually close the road to everyone if things get out of hand. He can do this at anytime without the Town Board’s permission.
