CODE ENFORCEMENT OFFICER/BUILDING INSPECTOR
TOWN OF CANDOR

In order to establish an understanding of the expectations of the Town Board as regarding the Code Enforcement Officer/ Building Inspector for the Town of Candor, the following guidelines were established by resolution #01/09 of the Town Board to be effective 9/8/09.

OFFICE HOURS

A minimum of 10 hours will be spent in the office per week. Office hours will be posted for the public. An average of 40 hours per week will be devoted to the job. This will include both hours worked in the office, in the field, and at training.

INSPECTIONS

Response time will be within 48 hours from the time of request for all inspections, excluding Sundays.

REPORTS

A monthly report to the Town Board will be due at the first meeting (the second Tuesday) of each month for the prior month including; permit applications, inspections, certificates issued, total hours worked, and separate total working mileage for use of personal vehicle.

DAILY LOG

The Town requires a log to be maintained of in and out of office hours. Out of office hours to include but not limited to job site, work performed, time spent and mileage for personal and/or town vehicle.

MEETING REQUIREMENTS

Attendance will be required at the Board meetings each month (second and fourth Tuesdays), Planning Board meetings when needed (first Tuesday), and any and all meetings deemed necessary by the Town Board from time to time.

SECTION 1. VACATION: The CEO/BI shall be entitled to annual vacation with pay based on the following length of service

Vacation must be scheduled in advance and approved by the Town Supervisor

SECTION 2. Employee shall be allowed to carry up to 10 (ten) days of non-cumulative vacation. Any remaining unused vacation in balance will be forfeited by the employee. At no time shall an employee be allowed to have more than 30 (thirty) days of vacation on the books.

SECTION 3. SICK LEAVE: One day of paid sick leave shall be earned each month worked, for a total of twelve days per year.

This time can be accumulated up to 180 days. The employee shall notify the Town Supervisor or the Town Clerk in the event of absence due to illness.

SECTION 4. For the purpose of computing and measuring holiday, vacation and sick leave, the term "day" shall mean eight working hours and the term "week" shall mean forty working hours. Vacation, sick, and personal time shall be tracked in hours or fractions thereof.

PENSIONS, HEALTH INSURANCE, DISABILITY INSURANCE

SECTION 1. PENSION: The CEO/BI shall be eligible to participate in the New York Employees Retirement System, under the so-called 1/60th non-contributory retirement plan as provided by section 7S-i of the retirement and social security law, retroactive to 1938, for tier 1 and tier 2 members. Tier 3 employees (hired between July 27, 1976 and before September 1, 1983) are covered under article 14 and/or 1S and tier 4 employees (hired after September 1, 1983) are covered under article 15 of the New York State Employees Retirement System. Both of these plans are contributory effective June 1, 2004, upon retirement, an employee's accumulated unused sick leave may be counted as additional service credit, as per section 41j of the New York State Retirement System.

SECTION 2. HEALTH INSURANCE: The CEO/BI shall be eligible for membership in the Blue Cross Blue Shield Central New York Region Wide Health Insurance, as carried by the Town of Candor through TCCMHIP.

The CEO/BI employee who retires while employed by the town and has ten (10) years of uninterrupted service with the town at the time of their retirement, will be eligible to receive health insurance coverage after retirement. All employees retiring after January 1, 2004 and are eligible for health insurance upon retiring will contribute to the town for health insurance commensurate with rates of current employees.

In lieu of health insurance, if the employee has other coverage, the Town shall add to the employee's annual salary $3,000 for an employee eligible for family coverage.

SECTION 3. Disability insurance shall be provided by the town. The Town will assume full cost of the program.

PERSONAL AND BEREAVEMENT LEAVE

SECTION 1. CEO/BI shall be entitled to a maximum of three days of personal leave for emergency situations, such as fire, accident, or illness affecting a member of the immediate family, provided that the Town Supervisor or designated representative approves, without deduction from salary or wages or from vacation, sick leave, or other allowance.

SECTION 2. CEO/BI shall be entitled to three days of bereavement leave, without deduction from wages or vacation, sick leave or other allowance. This leave shall be granted in the event of the death of a spouse, child, parent, sister, brother, mother-in-law or father-in-law of an employee.

OVER-TIME PAY

All paid over-time must be pre-approved by the Town Board.
