Assessor Consolidation Agreement
ASSESSOR CONSOLIDATION AGREEMENT BETWEEN THE TOWNS OF CANDOR AND TIOGA
The Towns of Candor and Tioga, having determined to
consolidate the position of Assessor, set forth the following
agreement which defines the terms and conditions of the
office of Assessor.
General
- The total number of property parcels in both Towns shall
be determined as of August 1st of each year and the ratio
of each Town's parcels to the total shall be established
for thee next budget year.This ratio shall then be used to
determine the portion of the following costs to be paid by
each Town.
- all contractual expenses included in the Town budgets
except the Real Property System maintenance fee
- Assessor salary
- Assessor health care insurance
- Assessor Clerk health care insurance (when applicable)
- Worker's Compensation claims
- Training/schooling
- Each Town Board shall appoint two representatives to form
an Assessor Committee which shall handle the affairs
concerning the Office of Assessor as defined in this
agreement.
- Actual expenses incurred by each Town for the following
will be paid by that Town.
- Assessor Clerk time
- Assessor Clerk mileage
- Assessor mileage
- Real Property System maintenance fee
- Postage
- Bills associated with shared Assessor expenses will be
paid in full by the Town to which they are sent. That Town
will then bill the other Town for their portion of the
expenses with a voucher plus support documentation.
Assessor Committee
- This committee shall be empowered by each Town Board to
make decisions for the Towns within the confines of this
agreement.
- Decisions made by this committee must have the unanimous
agreement of the members. If unanimous agreement cannot be
reached a motion shall be drafted by the committee which
states either a pro or con position on the matter to be
decided. This motion shall then be presented to each of
the Town Boards with an explanation of the differences of
opinion. Each Board shall then vote on the motion and if
the vote is the same by both Boards the result will be the
final decision on the matter. If the Board votes are not
the same the Town Supervisors shall confer and determine
the next step to be taken.
- This committee shall ensure that a qualified person is
recommended to be appointed to the position of Assessor.
- This committee shall be responsible to recommend for hire
an Assessor Clerk who has the capability and commitment
to train to be a certified Assessor.
- This committee shall meet with the Assessor at least once
every six months to give opportunity for direct
information interchange. Additional meetings may be
called by either the committee or the Assessor as
necessary.
- This Committee shall be responsible for examining and
determining justification for additional staffing in the
Assessor's office.
- This Committee shall meet at least once every three
months to review Assessor office activities and to ensure
continuity between the two Towns.
Assessor
- The duties and benefits of the person who is selected by
the Assessor Committee and appointed by both Town Boards
to fill the office of Assessor shall be as follows.
- Duties
- 1) The Assessor shall perform all of the duties and
responsibilities required of an Assessor by law.
- 2) The Assessor will participate in the process of
selecting an Assessor Clerk when such selection becomes
necessary.
- 3) The Assessor will meet with the Assessor Committee at
least once every six months to give a status of
activities and to discuss any other items pertinent to
the office. The Assessor may request meetings with the
Committee as often as deemed necessary.
- 4) The Assessor shall prepare a monthly report for the
Committee which shall include information on the
following:
- an overview of the activities of the previous month
- schooling I training taken
- Assessor hours worked
- Assessor Clerk hours worked (by Town)
- mileage by Town (Assessor and Clerk)
- vacation time taken (Assessor and Clerk)
- sick time taken (Assessor and Clerk)
- other information of which the Committee should be
aware
- 5) The number of hours the Assessor works shall be a
minimum of 40 per week.
- 6) The Assessor shall bring all matters that require a
Town Board decision to the Committee. The committee
will then present the matter to the Boards with a
recommendation.
- 7) The Assessor will define the specific job duties of the
Assessor Clerk.
- 8) The Assessor will assist the Assessor Clerk with the
courses required to become a certified Assessor and
shall ensure that the Clerk is getting the appropriate
on-the-job training.
- Compensation and Benefits
- 1) The Assessor's annual salary shall be determined by the
Assessor Committee. Factors used to establish the
salary will include. but are not limited to. length of
service. increase or decrease in workload. job
performance in general.
- 2) The Assessor shall be provided with health care
insurance under one of the Town's plans. The Assessor
may choose which plan to be covered under.
- 3) Continued health care insurance benefits shall be
provided and paid for by the Towns for an Assessor who
has reached the age of eligibility for retirement under
the New York State Retirement System and who has served
the Towns in full time capacity for a period in excess
of ten years and who is actually in service to the
Towns at the time he/she elects to retire between the
date of such retirement and his/her eligibility for
Medicare Benefits in the same manner as such health
insurance benefits are provided to Town employees who
have retired from service to the Town of selected
coverage.
- 4) Expenses incurred for training/schooling which is
required or desired for the Ass~ssor will be paid for
by the Towns prior to reimbursement by New York State.
The Assessor shall inform the Committee of the exp~cted
training/schooling and obtain Town Board approval prior
to making application.
- 5) The Assessor shall be granted paid vacation time for
each year based on the following schedule (unless more
time has been earned through continuous service as
Assessor Clerk).
- two weeks after completing one year
- three weeks after completing eight years
- four weeks after completing fifteen years
- 6) The Assessor shall be granted ten paid holidays as
listed below:
- New Years Day
- Lincoln's Birthday or Washington's Birthday
- Memorial Day
- Independence Day
- Labor Day
- Thanksgiving Day
- Friday following Thanksgiving
- Christmas
- Two additional holidays floated throughout the year
- 7) The Assessor shall earn a day of paid sick leave each
month to a total of ten days per year.
- a total of one hundred sick days may be accumulated
- sick days will not be paid upon retirement
Assessor Clerk
- The requirements and benefits of the person recommended
by the Assessor Committee and appointed by the Town
Boards to fill the position of Assessor Clerk shall be as
follows.
- Requirements
- 1) A commitment of at least four years to the job is
expected.
- 2) The work week shall be a minimum of 30 hours and a
maximum of 40 hours unless different arrangements are
made with the Committee.
- 3) The Assessor Clerk shall work under the direction of
the Assessor
- 4) The Assessor Clerk shall take and complete the courses
required to become a certified Assessor
- 5) The Assessor Clerk shall document the number of hours
spent on each Town's business each month.
- 6) The Assessor Clerk shall record each month the number
of miles the Clerk's car was driven for each Town's
business.
- Benefits
- 1) The starting wage for the Assessor Clerk's position
will be $6.00 per hour
- 2) At the end of the first six months of satisfactory performance the wage will increase to $6.50 per hour
- 3) Further wage increases with continued satisfactory performance will be per the following schedule:
- end of one year - $6.75 per hour
- end of one year and six months - $7.00 per hour
- end of second year - $7.50 per hour
- upon completion of courses for certification as an Assessor - $8.00 per hour
- 4) Health Insurance
- If uninsured the Assessor Clerk may participate in
either Town's health care plan at the end of six
month's satisfactory performance.
- Continued health care insurance benefits shall be
provided and paid for by the Towns for an Assessor who
has reached the age of eligibility for retirement under
the New York State Retirement System and who has served
the Towns in full time capacity for a period in excess
of ten years and who is actually in service to the
Towns at the time he/she elects to retire between the
date of such retirement and his/her eligibility for

insurance benefits are provided to Town employees who
have retired from service to the Town of selected
coverage.
- 5) The Assessor Clerk will have the option of joining the
New York State Retirement System.
- 6) The Assessor Clerk shall be granted paid vacation time
for each year based on the following schedule. Pay will
be based on a 35 hour week.
- one week after one year
- two weeks after two years
- three weeks after eight years
- four weeks after fifteen years
- 7) The Assessor Clerk shall be granted ten paid holidays
as listed below:
- New Years Day
- Lincoln's Birthday or Washington's Birthday
- Memorial Day
- Independence Day
- Labor Day
- Thanksgiving Day
- Friday following Thanksgiving
- Christmas
- Two additional holidays floated throughout the year
- 8) The Assessor Clerk shall earn a day of paid sick leave
each month to a total of !en days per year.
- a total of one hundred sick days may be accumulated
- sick days will not be paid upon retirement
- 9) Both 7) and 8) are based on a seven hour day.
As authorized by resolution adopted by the Town Boards of
Candor and Tioga on December 14.1993.
